Im new to the forum seen i have found alot of useful information in the past to help me through my troubles.

My story go's like this I meet my wife in august 2010 travelled to and from Thailand visiting her until January 2011.

When we got our 3 month 676 visa approved we travelled to Australia for the 3 months and my wife returned back to Thailand.

At the beginning of April I then allpied again for another 676 tourist visa for 6 months it was approved and she returned to Australia

late April. Whist on the 6 month 676 visa we had a big Australian wedding on our property. My wife and i returned to Thailand on the

24th of October and got started on our 309 partner visa (Provisional) I lodged it on the 8th of December 2011. I have been staying

here since October and was happy to wait out the visa process however whilst i've been in Thailand my Family business has acquired

some new accounts and my Father has had some health issues. My Family is pushing me to return to Australia to get back to work

is there a Bridging visa that we can apply for while we wait for my wifes visa. Any help you can give me would be greatly apprciated and

thanks for all the help your forum has provided me in the past.

Hi Trent

Your wife is not eligible for a bridging visa I'm afraid.

The most appropriate visa for her to apply for is a s/c 676 tourist visa.

Thanks for your quick reply do you think a 676 will be approved with how much time she has spent in Australia to date.

Who can say?

Off the top of my head, I think that's basically the only visa

she would have a chance of getting.

You can only put in a good application and hope for the best.

Hi all...Just after a little knowledge / info along similar lines to Trento, regarding bridging visas. Story briefly is :

  • My partner and I commenced relationship Feb 2010
  • We have a son 21 months old...born Nov 2010...he has Australian Citizen by Decent, Oz and Thai passports
  • He is on my Medicare card
  • Partner has Australian TFN
  • My partner granted a 6 month tourist visa Nov 2011 to May 2012. We applied for 'up to 12 months'....got 6
  • On our return to Thai last May we applied for Partner Visa 309 / 47SP, on the grounds of defacto partner, our intent to marry in Thai on my return
  • After medical / police check / certified a couple of docs....all good, finally placed in a queue for decision on 7th August 2012...according to Oz Embassy BKK....over 100 cases in front of her and up to 12 month wait for decision.
  • Have all that is required to substantiate relationship / my income / my support to her and my son etc, and a well put together application.
  • My son is free to travel anytime...back and forth, being duel citizen and passport holder.

I am obviously missing them and wish things would move a bit quicker, to get them back here...my main question is -

  • If she was to return here on another TVisa, be it 3 or 6 or 12 months, would we be able to apply for a bridging visa here in OZ at the end of the TVisa...whilst awaiting the outcome of the Partner 309 ?
  • Main aim to get them back here sooner...then wait the outcome here in OZ...should be no problems with a favourable decision as we have 'ticked all the boxes'
  • If we went down this track and a 'no further stay' condition is placed on the TVisa, does this negate any chance of a Bridging Visa ?...
  • What would happen if her 309 visa was granted during her stay here on a TVisa...would she have to leave then come back ?

Just wondering has anyone been down this path successfully or not ?

Appreciate any words of advice....cheers all....

I doubt your wife would be eligible for a bridging visa. See the link on bridging visa's above provided by simple1.

The current waiting times for spouse visa's seem to be approx 6 months at the moment.

To answer your questions:

* If she was to return here on another TVisa, be it 3 or 6 or 12 months, would we be able to apply for a bridging visa here in OZ at the end of the TVisa...whilst awaiting the outcome of the Partner 309 ? No

to be offshore for the granting of her 309 visa.

IMO, your best bet is to apply for another tourist visa. If she happens to get 8503 "No Further Stay", then she can apply for an extension.

So if she get's a tourist visa in October for 3 months, there shouldn't be that long to wait for the 309 visa.

A fantastic development in the last 24 hrs....notified by email from OZ Embassy BKK.......my defacto (we are not married as yet) and mother of my son - Partner(Migrant) subclass 100 Permanent Visa..............granted !!

She wasn't required to fulfil the 309 requirements.....just staight to the 100. Visa lasts for 5 years.

Some details - Lodged 30/05/12, Granted 21/09/12, Can remain indefinitely in Australia until 21/09/17, Must enter by 2/06/13, No other specific conditions.....

Yehaa, so happy !!!!

Now after all the process, my advice to others -

  • Be true and genuine -- in applcations / correspondance, don't try to gloss it up, tell it how it is, the people doing the reviews and assessments have seen all the tricks and lies before !
  • Keep a very detailed history of relationship
  • Keep good records of all correspondance, dates, diarize EVERYTHING
  • Submit detailed applications (copy everything)....even if a little overboard, no harm in giving them more info than they request, they will discard what they dont want, but at least they will have it.
