hi there ,i am a EU citizen,own a thai company n plannin to open a restaurant in mae hong son area.will apply for a non B single entry in Kuala lumpur.then work permit in thailand.my accountant tells me if i apply for one year extension in thailand the tax office will charge me a 4000-5000bath minimum a month + i will need to have minimum 2 thai people staff.

she said if i go outside thailand (EU,UK ,Malaysia etc.) again to apply for 1 year extension they will not charge the minimum tax and 2 people staff is not required. TRUE??also applying this way will i be able to report at checkpoints or will have to go to the border every90 days? would love to know before flying around....anyone in the same situation in chiang mai ,mae hong son area?thanks folks

Not sure about what you are telling. But there is a difference between the requirements from the labour office for a work eprmit and the requirements from immigration for an extension of stay.

For an extension of stay from immirgation you will need to show tax documents, which a new company cannot show as they are not long enough in busines. You must be in business for at least 1 or 2 years. Till then your only option is to get a multiple non-B and stay on that till you qualify for an extension of stay and can show all the relevant documents..

If you already have a Thai company then you must already comply with the Thai employee requirements for a limited company ie THB 2 .0 mil company 4 X employees, if married to a Thai national, THB 1 mill company + 2 employees.

If company has in operation for 2 years or less, you will not get an extension of stay, as regards getting an extension of stay out side of Thailand, not having to pay tax and the employee question...your accountants dont know what they are talking about...this is all not true

Until you get an extension of stay in Thailand, you will be jumping the border every 90 days

thanks for answerin.yes the company is older then 2 years and yes m concerned about accountant's knowledge..it just sounds 'funny' :if i go out again n apply they will not charge minimum tax/minimum staff...

Below is the MFA list of documents required for B visa - in addition Consulates may set work permit validity requirements to issue multi entry version.

(2) Foreigners who wish to conduct business in Thailand must provide the following documents:

- Passport or travel document with a validity of not less than 6 months.

- Completed application form.

- Recent passport-sized photograph (4 x 6 cm) photograph of the applicant taken within the past 6 months.

- Evidence of adequate finance (20,000 Baht per person and 40,000 Baht per family) for the duration of stay in Thailand

- Letter from the applicant’s company indicating the applicant’s position, length of employment, salary and purpose of visit(s) to Thailand.

- Documents showing correspondence with business partners in Thailand.

- Evidence of financial status in the case where the applicant is self-employed.

- Letter of invitation from trading or associated partners/companies in Thailand.

- Corporate documents of associated partners/companies in Thailand such as:

1) business registration and business license

2) list of shareholders

3) company profile

4) details of business operation

5) map indicating location of the company

6) balance sheet, statement of Income Tax and Business Tax (Por

Ngor Dor 50 and Por Ngor Dor 30) of the latest year

7) value-added tax registration (Por Por 20)

(3) Copies of company documents must be signed by the Board of Directors or authorised managing director and affix seal of company.

(4) Additional documents may be requested as and when necessary. In the absence of a required document, applicant must provide a letter explaining the unavailability of such document. Applicant must endorse on each and every page of the submitted copies of documentation. Documents in foreign languages must be translated into Thai and should be notorised by notary organs or by the applicant’s diplomatic or consular mission.

(5) Holder of this type of visa is entitled to stay in Thailand for a maximum period of 90 days. He or she may apply for an extension of stay at the Office of the Immigration Bureau and may be granted such extension for a period of one year from the date of first entry into Thailand.

Probably the OP has been advised that if he gets a Work Permit, uses that to get a One Year Multiple Entry Non Immigrant Type 'B' Visa outside of Thailand, then there is not the tax paid on 50,000 THB pcm salary requirement as with an Extension of Permission.

However most local Labour Departments will require evidence of 4/2 Thai Employees before issuing a Work Permit.

I still read of people getting Business One year Multi Entry Non 'B's from outside of SE Asia with just a Company Invitation Letter.

With a 1 year multiple non-B you leave the country every 90 days and there is no need for 90 day reporting, as you don't stay for 90 days.

Tax exemption is on the year income, I believe the first 150,000 income is tax free.

You are not exempt from taxes, on THB 50,000/m you will be paying tax.

There is an annual threshold which is tax free....you would be earning THB 600k/year....a portion of this will be tax free, but not the whole amount, you need to look at the tax tables, which will tell you roughly how much tax you will be paying...further on you need to prove you have been paying tax when WP renewal time comes around

You cannot apply for an Extension of Permission to Stay outside of Thailand, but you can apply for a Non Immigrant B Visa (Single Entry 90 Day without, One Year Multiple with WP).

As has been already posted, you need to show taxes on 50,000+ THB pcm for an Extension.

Even if you get a Work Permit and you are on 90 day Non Immigrant Type 'B' entries you still need to pay tax on declared income.

thank you much for the info,i never considered working without a work permit.i posted to try to clear some grey areas.since i heard that if i applyed outside thailand for a 1 year extention holding a single entry +work permit i didnt have to pay the minimum taxes(on 50000bht now i know) and possibly didnt need a minimum of 2 staff. but apparently this is only a rumor.. (?)

The minimum income requirement of 50,000 baht is not there when you are on a visa entry and not on an extension of stay. As that is an immigration requirement for an extension of stay and one reason why many people stay in Thailand on non-B visa entry and don't get an extension of stay.

so what the accountant said is correct?if i take a second trip to mamaysia and apply for a 1 year B visa with work permit in hand ,i will not be subject to minimum tax? (honestly speaking the reastaurant is not open yet and will hardly make that income. that is why i am concerned about .starting this -thanks again for reply

You cannot apply for an extension outside of Thailand, whether you have a Work Permit or not.

You can apply for a One year Non Immigrant B Visa outside of Thailand with a Work Permit and the Correct Papers, this is not an extension - it is a new Visa Application.

It depends on your local Labour Dept and your marital status as to how many Thai employees you need to obtain a Work Permit.

And without meeting conditions of item 6 of post 5 suspect any such visa may be single entry even with a valid work permit.
