Guardian, Visa. Any Advice Please.

I remember reading on an earlier forum about a 'Guardian' visa. Apparently if you are the father to a child born to a thai in Thailand, but not married it is possible to get this type of visa.

You are required to have 400 k bht in your thai account or equivalent monthly income. Your name has to be on the birth certificate a letter is also required from the City hall or if living on an island the Govt office responsible for this and signed by two thais ,this can then be taken to your immigration office.

My Ques is has anyone used this before, do the local immigration recognise it.

It is a local extension of stay provided by Immigration to support child under section 2.18(5). Exact requirements will vary by age of child and where done.

1. Application form

2. Copy of applicant’s passport

3. Copy of documents proving relationship, such as a marriage certificate, a birth certificate,

registration of child legitimization, household registration certificate, child adoption registration

certificate, or other evidence from the government or relevant agency

4. Copy of evidence proving the Thai nationality of the spouse, parents, children, or adopted

children, such as a national ID card, copy of household registration certificate, or other evidence

issued by the government or relevant agency

5. Only for Criteria (5) and (6), the applicant must attach a funds deposit certificate issued by a

bank in Thailand and a copy of a bankbook, or attach documents proving that the parents or alien

husband earns an average monthly income of no less than Baht 40,000 throughout the year, such as

any particular individual income tax return together with payment receipt, evidence of receiving

retirement pension, evidence of receiving interest from funds deposit, or evidence of having other

funds issued by the relevant agency. An affidavit must also be submitted confirming the alien’s

marital or parental status with a Thai national.

this is an extension to a non immigrant o visa

i have this type of extension, in addition to the above.

my immigration office now ask for a minimum of 500 thousand baht in a thai bank

and also photo's of the mother, kid, and yourself all together outside of the family home.

a letter from the mother saying that you are supporting the child.

a court order reconising you as the legal father in thailand.

i know other farang that have tried to get this extension and been told that it was abolshed in october 2006,

but i also know men from asian countrys that obtained this type of extension after that date

From the 500,000 comment I gather you use the Phuket immigration office.

I believe the rule changed in 2006, and it changed again in 2008.

The 500,000 baht number is absolutely not according the rules. The correct number is 400,000 baht or 40,000 baht of income.

Police order 777/2551 clause 2.18 firmly establishes an extension of stay for a single parent of a Thai child.

Before that it was written such than no money in bank or income was required.

The 500k requirement would be to accompany your child who is a student in Thailand (normally only used for a foreign student on an ED visa entry).

For application of any extension from Immigration you used a TM.7 form - below is direct download of the Word form fill-able version (print on both sides of one A4 paper).

Yes 500,000 is when you use the phuket office

also i think the requirment to have to photo's tasken outside of the family home may be for a marriage visa but still im being asked for this.

seems like i need the requirements from every other type of visa to apply for this thye of extension
