Registered Capital For Work Permit With Thai Wife

My question is about work permit for a foreigner who married a Thai wife. my foreign friend has a business in Thailand. The company has 4 mil baht capital, so they hire 2 foreigners (no Thai wife), with 8 Thai staff rules. Now they want to add one more foreigner who married a Thai lady (not mesmile.png ). The question is how much capital the company has to have and how many Thai staff they should have. total of 5 million baht and 10 thai staff, or 6 million baht and 12 Thai staff?

I am also curious that if the foreign owner of the company married a Thai, the rule about 1 million baht capital with 2 Thai staff should apply to this company in general or not. For example if this company hires another foreigner (with no Thai wife), should they add 1 more mil baht and 2 staff?

Also in practice, the capital doesn't have to be paid up, right?

I check about the labour regulations but it doesn't clear to me in details. If any one can help me, I will appreciate. Thank you.

If the next foreign employee is married to a Thai then the Company Capitalisation needs to increase by 1 Million and the Thai employees by 2.

Correct the Capital does not have to be paid up, although it is more expensive to register the increase in Capitalisation per million after formation.

Any doubts then check with your friend's local Labour Dept for confirmation.
