I am staying in an apartment and married and now want to apply for O Visa but don't actually own a house so what do I do? I also heard the Phu Yai has to confirm we are married????? Any advise.

They might require one or two witnesses. It all depends on where you apply and who you see on the particular day.

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

Letter from your Thai Bank showing balance and up to date bank book.

OR.

Letter from your Embassy showing income. Now may also need proof of income as back up.

Marriage Certificate

Marriage Registry entry.

Wife's Tabbien Baan and ID Card.

Your Passport.

Copies of everything.

Photos of you and your Wife in and around the house.

A map showing the way to your house.

Passport size photos and 1,900 Baht fee.

Take your Wife to be interviewed.

You will be given a 30 day under consideration stamp.

Go back in a month and get the remainder.

This is for extension of stay from immigration; not for a Consulate issues visa.

Stand outside with apartment number in view - just a show of where you live. If witness are asked it is to say you live together as husband and wife. That is also why they normally want another photo of clothing hung together so help support the living together.

Usually use the 40,000 baht a month route, but last year was advised by immigration to use the 400,000 in the bank account route, can this be in a fixed term deposit for say 11 months as i dont need to use the money ?

Normal fixed deposit is usually accepted (the kind where you deposit money and can withdraw at any time with only a loss of interest). What is not accepted are the non cash funds that are sometimes touted for higher interest and not cash backed.
