Hello, I just wanted to double check that as my fiancee arrived in the UK before the new rules came into effect on settlement, does that mean she will apply under the old rules, or the rules for those who applied prior to 8th July? I just want to double check as we start our application.

Eh? I don't understand what you mean?

If your fiancee arrived in the UK before 8th July all the old "rules" will apply (I think).

The old rules apply for all settlement applications submitted before 9th July 2012. As she arrived in the UK on the 8th July then the old rules apply to her.

Except the language requirement for ILR.

As she will be applying for ILR after October 2013 she must have

• Passed the Life in the UK test. and
  
• Obtained level B1 of the CEFR in speaking and listening, or better
