My Thai girl friend is pregnant

We are not married

When the baby is born

Whose last name will the baby be given?

Is there a set law for this type of situation?

Can we decide if we give the baby her last name or my last name?

Without going to court, you will not be the (legal) father of the child. As a consequnece, you have no parental rights and formally the child cannot have your last name. Some amphurs will have no problem with giving the child your last name, others will.

Also report the birth to your embassy, so the child may have your nationality. Legitimizing the child under your own countruies law will not be recognised by Thailand, but will do it for your own country.

To make a legalized the children in Bangkok, it's mandatory to pass by the some lawyers ?

because I ask one, they asked me 70,000 baht.. so expensive.

It's a new born child, and the mother are Ok, to give the consent for do that.

I'm not married to my Thai GF and my surname was put on the Thai birth certificate along with English first and middle names. Never bothered registering the birth in the British Embassy in my point of view it was a waste of money. Applied for a British passport in the British Embassy in Bangkok in August for my child without a problem and received it 2 weeks later. Also applied for a Thai passport the following day and she got that week later. Hope this helps.

It's a new born child, and the mother are Ok, to give the consent for do that.

Believe not required, but makes it easier to go through the procedure.

Must have been an expensive lawyer. I don't think it should cost more then 25,000 baht. Especially if the mother agrees it is a very straight forward procedure and doesn't require a fancy lawyer. I would advise to shop around a bit and compare prices.

The father has, but you are legally not the father. Untill you file to become recognised as the father OR the mother or child files a paternity suit against you there can be no claim under Thai law.

Note under Thai law, as you might have legitimised the child under the law of your own country if you registered the birth there and/or applied for a passport for the child.

As I said, some amphurs will accept it and some don't. The amphurs that don't accept it are, in my humble opinion, doing it according to the law.

if you get seperated from your girlfriend, you will not be considered the father and have no claim to the child. Nor can you apply for an extension of stay based on the child.

Hey Mario Ive gotta ask, How come you know so much regarding topics about kids/family/marriage/divorce etc etc? You always seem to have the info in detail. Is it you have some sort of legal background or just have seen and been through enough over time?

You have legalised under US law, not under Thai law. It will not be a problem, unless the relationship with your GF goes sour and she wants to raise the child as her own. Then here in Thailand you currently don't have any parental rights as legally you are not the father. If the mother dies, the same goes if her family wants to take car of the child. You don't have any rights as the Thai courts are concerned.

Of course you can always file to be recognised as the legal father, but that will take time.
