After a simple solution!

A friend of ours has brought her daughter to Thailand on a Non Immg Type O single entry visa and now wants to stay for Songkran.

Friend Thai national with PR in Australia is travelling on Thai passport (no probs).

Daughter 7 months old travelling on her own Australian passport (born in Australia) travelled on Non Immg type O visa single entry which expires on 8 March. (entered Thailand 9 Dec - exit date 8 March)

Living in Khon Kaen so trip to Nong Kai no probs - can mother exit Thailand (accompanied by daughter) into Laos and back into Thailand on Border Pass?

Will daughter need $30 visa into Laos and what type of visa can she obtain when re-entering Thailand?

They want to stay for Songkran so 30 days not long enough - she was told in Australia because the daughter is under 7 years old she can just visit the police station and they can authorise the extension?

All advice appreciated.

There is no charge for overstay of a child so nothing needs to be done - when departing they will note the overstay but it will not case any problem.

If your friend is a Thai national, then his/her daughter is Thai as well. She could get a Thai passport for the future. Then when she uses the Thai passport to enter Thailand, she won't have any problems overstaying in Thailand.

Lopburi3 & KK thanks - the friend is a pessimist having even as a Thai she been hassled by Don Muang customs/immigration over a Thai issued passport on a previous visit and wishes to pursue some type of visa extension.

[Old story never argue with a woman so don't shoot the messenger please.]

I don't believe the new immigration office is up and running yet in Khon Kaen yet but you might check that option first. There is a provision of one year stay for a Thai citizen on a foreign passport but if she has no paperwork they may not want to issue that. I suspect they are going to say do nothing. She would require a visa for Laos and only receive 30 day stamp on return unless you visit Embassy for a tourist visa. Perhaps a better choice if she wants a tourist visa would be Savannakhet and believe they can do same day and more friendly.

People do use overstay every day of the year and it is the accepted method for children. It is even noticed so in Don Muang according to travelers. Obviously she does not want the "simple solution".

I suggest she obtains a Thai passport for her daughter in the future. It would be the simplest solution, perhaps not for this time, but for future times. She would first need to obtain a Thai Birth Certificate from the Royal Thai Embassy in Australia. If she already has this then she could probably get her daughter's Thai Passport from one of the passport offices while they are in Thailand.

REQUIREMENTS FOR NEW PASSPORT OF THAI CHILDREN BORN IN AUSTRALIA

Children born in Australia can apply for a Thai passport provided one or both parents are Thai national(s) with an existing Thai passport.

1. Thai Birth Certificate

2. Parents’ valid passports together with 1 copy of pages 1-5 of passports

3. One copy of marriage certificate of parents

4. Both parents must be present to sign the consent form; otherwise, must comply with requirement 5 below.

5. Consent form and Power-of-Attorney from parent who is not a Thai national, authorizing Thai parent to apply and obtain a Thai passport for his/her child and; in cases wherein only one parent is present at the time of application.

Simple solution now:

Let the kid overstay for now...no problems for the next few years to do so.

Next visit to Australia, organise all the proper Thai documentation and the child should re-enter thailand on the Thai PP. Sorted.

Good advice as long as they live in Sydney or Canberra. They are the only Thai offices in Australia that have the sophisticated camera's required for the new ePassports. It will be easier to do it in Bkk. Thai ePassports have a validity of 5 years only. No extensions are permitted.

Yes, I think it's like that until they're 12 or 14 years old?

I was told by Phuket airport immigration a child can stay visa-free until 7 years old (following the type of visa the mum/ dad has), but I cannot verify this info anywhere.

I understand that it is usual practice by Immigration and not by regulation. But T i T :o

Good point. Will all depend on the ability for them to get the Thai PP in Thailand though. If they don't have a Thai BC issued in OZ (as she was born there), they may not issue her a PP here.
