Hi

I have a non o based on marriage that I got in England, I recently got employed at an international school in BKK and they have provided a work permit. They are however saying that I cannot get a one year extension and that I need to continue to 3 monthly visa runs. They have stated I could reapply for a new non o and get a one year ext based on that but cannot on the original non o, or I could get a non b but I would have to get a new work permit.

Am I not in danger of my WP being cancelled if I do a visa run on a non O?

Suspect you may have a stamp in passport saying no work is allowed next to your visa? Labor should still issue a work permit and it appears they have and immigration should be able to extend for either work or marriage (depending on which paperwork or financials you care to use. Those stamps are intended to alert user that work is not allowed without a work permit. In worst case just cross border and obtain a new visa and go from there but I would visit immigration first as they should allow extension if you meet the conditions. Extensions can only be made during the last 30 days of a 90 day entry. Your work permit is not canceled because of a visa run - it is valid for the full time it says unless you quit work.

Thank you, I will visit immigration myself. What documentation should I request from the school to extend on the basis of employment?

I have a contract and work permit already in my possession.

School should know or someone who has done provide here or in the teaching section. You might be able to find with search. I have never done so can not answer. All extensions of stay cost 1,900 baht and require filling out a TM.7 form.

Why don't you do the extension based upon marriage to a Thai. With an extension based upon working if you loose your job you loose your extension which would not be the case of the extension based upon marriage.

You could either show 400K baht in the bank for 60 days or 40K baht income which could be proven by showing income tax payments for your job.

The problem being that some Ministry of Labour offices do not like issuing work permits against a Non Immigrant O visa, this has happened a few times and been mentioned on here, but there again some offices do, so luck of the draw.

If you extend your Non-O for work purposes you'll need a package from the school including a letter from MOE. They should know what is required.

If you extend for work you extension is tied into your employment. If you quit or are fired, you must exit Thailand within 24 hours. You can apply for a 7 day extension or, if you are married to a Thai.a 60 day extension. If you have the finances, either 400k in a Thai bank in your name seasoned for 2 months or 40k/month income, you can apply for a 1 year extension based on marriage and the visa is not tied into your extension. As stated, a few labor offices will not issue work permits on Non-O visas, but since you already have one I asssume your office will.

Also, is there a cost involved?

If it is an extension of stay normally 1,900 Bhat. I'm a teacher and go through all the hoops with W.P.'s, Non B's, changing schools, work permits etc. Plus the constant cost, if contracts are not renewed before permission to stay ends, more visa runs. It seems to be everytime you piss or shit you pay immigration 1,900 Bhat, takes away the enjoyment of living and working here.

I am unsure as to whom may be advising you re your work permit and any visa extensions but what is clear that the only officers qualified to advise on a work permit are officers who work for the Labour Department. The local office I have used for the Pattaya area, is based in Chonburi and I have found the officers to be very helpfull. I should give them a call to clarify your situation. The total cost of a one year work permit is 3,000.00 Baht. I believe that you have no need to leave Thailand every 3 months for a passport stamp, rather I am sure you qualify for a 3 monthly report to the immigration department. This can be done by advising them in a letter by post if you cannot attend in person. Do not send your passport by post! I would advise that you speak directly to the Bangkok Immigration office, where you can be assured of good service.

The MOE adds a 100 Bhat to the one year 3,000. becomes 3,100 and the 6 month for 1,500, becomes 1,600. It's for the smiles they give you.

There is no question about the work permit. He has that already.

Many companies do not qualify for a person to get an extension of stay at immigration for working. One of most common is salary and company tax payments and etc. This is why many people have multiple entry B visas.

Op can get an extension of stay based upon marriage to a Thai.

Thank you for all of the advice, regarding documentation required to extend the non o, how many months of earnings of at least 40k per month must I show?

I do not have 400k in the bank. Also, is there any other paper work involved?
