Well the time has come to fill out Set M but from what I see the questions are wrong! I am talking about section 3, children under 18.

Hard to explain but if you can imagine that 2 years ago my wife and my stepdaughter came here to live with me in the UK so we are now applying on Set M and the questions in section 3 are a bit vague, question 3.4 reads

If you have answered ‘yes’ to question 3.3 are any of these children subject to immigration control?

I think they mean yes to question 3.2 and then it would make sense and fill her details in 3.5

Then there is 3.6 this would be suitable for children together as it says at the top, but then why if the children are together and you were filling it out does it ask on O, if the sponser is not the other parent?

I rang UKBA and they didnt know either and just told me to send a covering letter, its more apparant if you look at set m and put yourself in my shoes!

I.E Does your partner have any children living in the the UK from a previous relationship.

Tick the boxes Y or N

You only have to answer Y or N onwards,which you can't go wrong.

Your wife is the applicant and her daughter is, presumably, being included in the application. You are your wife's sponsor. Her daughter is your stepdaughter. Part 'O' says "If your sponsor is not the other parent of this child.............." You are not the other legal parent of your stepdaughter, unless you have formally adopted her, so you fill in the details of your stepdaughter's biological father; her other parent.

Simple.

yes but what I mean is at the top of that sheet it says " do you have any children together" well the answer is "no" so you wouldnt even get to that question o would you?

If you follow the questions exactly how they say yes or no etc... there is nowhere to fill out the applicants dependants details at all, the only near question is 3.2 which talks about the applicants children whose partner (me) is not the parent.

All the other questions seem to relate to any children I the partner may have and are they also under visa control maybe from a previous relationship etc... there is something not quite right with the numbering,

I have written a covering letter as follows to be safe:

There has been some considerable confusion with completing section 3 of the form “Children under 18”, I spoke to your advisor “ on 0870 606 7766 on 19/10/12 at approx. 16:00, and after some time of checking with other colleagues, they came to the conclusion that the form is slightly incorrect since the last revision which is causing some confusion and to send a covering letter such as this.

The main confusion is question 3.4

If you have answered ‘Yes’ to question 3.3 are any of these children subject to immigration control?

Your advisor assumes that this question should read:

If you have answered ‘yes’ to question 3.2 are any of these children subject to immigration control?

So in this instance we have amended the question in 3.4 to read 3.2 (not 3.3) and answered the question accordingly.

Your advisor also feels that the dependant’s details should be filled out in section 3.6 although the title at the top implies it is not relevant.

So in this instance we have answered the questions that are required in section 3.6

I have also included the pages filled out without these amendment’s in case we have done this wrong, this is attached to this letter.

Am i worrying? I am not a troll - I have found this forum tyhe best and so kind in the past, but I just cant get my head around the form - it makes no sense if you answer the question as they want then the dependants name is not even on the form, and the wording under the main title of the section is entitled about the dependants
