Thaksin sues Boonlert, MP for defamation

BANGKOK: -- A lawyer for former prime minister Thaksin Shinawatra yesterday filed a defamation complaint with police against the leader of the anti-government group Pitak Siam and a Democrat MP.

Worawit Laolaeng filed the complaints on Thaksin's behalf at the Dusit police station.

In the first complaint, Thaksin alleged that Pitak Siam leader General Boonlert Kaewprasit and other organisers of the group's anti-government rally on November 24 played an audio clip of someone verbally attacking the monarchy, and deceived the protesters by telling them the recording was of Thaksin's voice.

Thaksin said in a letter handed to police by Worawit that the voice was not his, and that rally organisers had showed a picture of him while the recording was played to create the false impression that it was his voice.

In the second letter, Thaksin alleged that Democrat MP Withoon Nambutr defamed him during the censure debate on November 25.

In another development, the Juvenile Court dropped charges against two teenage boys accused of taking part in the arson attack against CentralWorld on May 19, 2010.

The court ruled that the public prosecutors lacked evidence and witnesses to prove that the boys, aged 16 and 17 at the time of the attack, had taken part in setting fire to the shopping mall.

The boys were charged with collaborating with red-shirt guards Saichon Paebua and Pinij Channarong, along with other suspects who remain at large, in setting fire to the shopping mall during the crackdown on red-shirt protesters, causing a man to be killed inside the mall. The man was identified as Kittipong Somsuk.

The court ruled that the two boys were arrested at 5pm on the day of the fire, but the authorities did not find any items on them that could be used to implicate them in the arson. Moreover, the two do not appear on security camera footage. The boys testified that they were scared by the crackdown and simply hid inside the mall.

The two boys and their lawyer asked the government to pay compensation to them, saying the long trial had cost the boys their jobs and caused them to leave school.

The South Bangkok Criminal Court has yet to hear testimony in the case against Saichon and Pinij, two red-shirt guards. The public prosecutors presented the last witness to the court on November 5.

Earlier, the court dropped charges against six suspects accused of robbing CentralWorld. The suspects are Pinij, Wisit Kaewla, Arthit Baosuwan, Pornchai Lohitdee, Yutthachai Sinoi and Jiam Thongma.

In another development, the Appeals Court yesterday delayed reading the verdict in a defamation case filed by Thaksin against Sondhi Limthongkul, a leader of the People's Alliance for Democracy, and 11 other people to February 19.

The 11 other defendants include former senator Chirmsak Pinthong and two academics, Chai-anan Samudvanich and Pramote Nakhonthap.

Thaksin alleged the 12 defendants defamed him during a public discussion from May 24-28, 2006 at Thammasat University by accusing him of creating what they called the "Finland Agreement" to have the Thai Rak Thai Party seize control of Thailand.

A lower court earlier rejected Thaksin's suit on grounds that the defendants did not say that Thaksin and Thai Rak Thai had made the "Finland Agreement" with anyone in power. The court also ruled there was no statement affirming the existence of such an agreement.

Thaksin and Thai Rak Thai appealed the ruling. The Appeals Court yesterday delayed the verdict announcement on grounds that Pramote had not been informed of the planned reading.

I think the fact that this is even allowed to happen raises questions. Like why hasn't any other nation picked him up and sent him back to Thailand? Why hasn't Interpol done anything?

The fact that his lawyer is knowingly working for a fugitive, accepting money from a fugitive, should be evidence enough that the law is being scoffed.

I wonder why no one has ever gone after his support network here, just take away his voice, and with no one to listen, he'll disappear.

Just my opinion, getting tired of hearing the same old b.s.

When is "Thailand" going to wake up and stop this kind of bullshit from happening. It's just plain "wrong" that a convicted fugitive can file charges against someone else whilst being on the run himself.

A cry out to all the Thai's who read this Forum . . . please, please do something about this . . . don't just sit back and ignore it. It's only going to get worse.

We all know, this would be happening, didn't we?

And if it is not Thaksin himself, then someone else is gonna do it for another reason or the same reason or whatever...arai godai!

But really: it doesn't matter if he sues him or she sues her- this defamation law is just silly!

Everybody can sue everybody about anything said, if it is even slightly critical.

And all because of the stupid "face"- thing!

This country just refuses to grow up, because it is soooooo dam_n comfortable to have the defamation- law or the lese majeste- law, because it suits so many people, just to put the blame and shame on their political- opponent.

And THAT is all there is, to these cases.

You have to be joking, how in the hell can he start anything in the thai courts when he is a convicted felon with an arrest warrant against him. He should have to accuse these people face to face but that will never happen because he is a gutless coward, he just uses the money he stole from the people of Thailand to do it instead and of course the bullshit legal system.

If the voice wasn't Thaksin's then the Pitak Siam guys deserve to be sued. There is enough real stuff that is bad about Thaksin that there is no need to make stuff up.

Pitak Siam would get a lot more support if they didn't advocate coups and make things up about Thaksin.

Maybe...but I hope they wouldn't! Pitak SIAM...the hint is in the name!

Thailand's legal system is completely and truely broken.

It is more than the legal sysytem which is broken. The country is morally corrupt. Look for it to get a lot worst under the Shinawatra Dynasty as more checks and balances are removed for the benefit of their few.

This has to be a low point in morality for the Shinwarta clan. It should start of with a loud cry for changing the law. This is beyond ridicules. A clear showing of Thaksin's desperation to have the people remember him. violin.gifbeatdeadhorse.gif

Wasn't the point not about what the law says, but about the law not making any sense.

Would you, or anyone, really be arguing in defence of on the run convicted criminals being allowed by law, to sue people, were we not talking about Thaksin? I have my doubts...
