Changing From Non Imm 'o' To 'b'

Featured Replies

I'm currently on a Non Imm 'O' visa based on retirement as I'm over 50. This is my first visa of this type as I've previously come from the UK on the stamp at the airport for about 3 weeks and then earlier this year for 3 months on a tourist visa.

I keep getting asked to teach English apparently based solely on the fact that I can speak it. I have pointed out that I'm not a teacher but I would be happy to help if it were possible. I've no illusions about getting a teaching qualification although whilst in the UK I did an intensive 20 hours TEFL course with 100 hours online which I'm doing now. The main reason for this was to give me some insight into the difficulties involved in teaching. I'm glad I did this as it confirms what I thought about teaching being a lot harder than it looks.

My gf works for what she refers to as 'civil government'. I won't be too specific at the moment in case I regret it later but she is involved in organising training paid for by the government. Her department has asked if I would do a training course so that I could train those in her office to speak English. There seems to be a difference between teaching and training which I don't understand right now but it appears to make a difference regarding teaching qualifications, for Thais at least.

There is also a friend who runs a large business who she knows through her work and is also a friend of her family going back some time. This friend wants me to teach his 3 year old son to speak English. He's not that bad at the moment anyway as far as I can tell and this would involve just playing with him and speaking English. I've spent some time with him anyway. I'm not expecting to be paid for this but it may turn out that I am.

Sorry about the lengthy preamble but I thought it best to be as clear as possible about the situation as far as I know at the moment.

My question is if I were to start either of these options I would assume that a Non Imm 'B' would be needed? And a work permit as well of course. If I did this can I change the type of my visa or would I need to lose the remainder of my type 'O' and start again? Also if I was doing this now would the fact that I haven't done the first 90 days be relevant?

If you've got this far thanks for your patience and also for any replies.

You would need a work permit and for that would require a Thai company/organization employment. As you obtained your visa for retirement the local labor office would likely require you obtain a new non immigrant B visa with company documents

Thanks for that.

I think the same is required even if the work is voluntary which the teaching of the 3 year old is, at the moment at least. The work at my gf's office may be easier as they are part of the Ministry of Labour.

Just one other thing is there any difference if I'm married to a Thai which I'm not at the moment but we are intending to get married this year. In that case I can change the basis for the visa to marriage rather than retirement. Would that make any difference to the change to type 'B'? Obviously I'd still need the work permit.

That would make all the difference if you obtain a one year extension of stay for Thai wife as most labor offices will issue work permits on such. Also volunteer work would be on a non immigrant O visa entry rather than B.
