Having been here a few years and saying it would never happen to me of course it has. My ex Thai GF has cleared off with my 15 month old daughter who has a British passport . I know they live in chonburi but do not have a forwarding address. Me and the ex were never married. As far as i can see that means i do not have any rights?

I presume you did not have a family court document recognising you as the father ?

Optins limited otherwise I would expect other than to try to negotiate with her and strike a deal.

Make sure that deal is in writing and at the courts if possible.

You don't have any rights in Thailand, sorry to hear of your plight.

It really is important to marry the mother of your children in Thailand, if you want to retain any rights over the children.

Name is on the birth certificate but as she cleared my house too it is all getting very messy

Currently you have no rights, as you don't are the legal father of the child. But you can petition the court to be recognised as the legal father and alos file for visitiation rights/shared custody with the mother.

See: http://www.thaivisa.com/forum/topic/381917-how-to-gain-parental-rights-as-a-father/

This would also make you liable for child support, the amount about which you can strike a deal with you ex-GF in return for access. A Thai judge will award between 3,000 and 6,000 baht a month plus sharing of medical and educational cost.

Trying to come to an agreement with the ex is always the best solution if possible, saves a lot of stress and money and makes the contact go smoother.

So did the child live with you alone, or your ex was still there ?

If you wish to care for the child yourself, unless she is an outright bitch and you have documented proof, doubt you will get it.

But get onto a lawyer and often if you find the right one, a simple phone call first from them to her can help pave the way.

we lived as a family so she was always here. her current solutioon is to leave the baby with grandma in chonburi while she works in pattaya so now she doesnt have either parent around.genius

This is if the mother agrees to such a request, as you are not the legal father in any way.

Also leaving the child with someone else is the thai way, so don't try to use that in any legal discussions, if she does sit at the table with you.

But, if he is recognised as the legal father the normal situation is that a child stays with one of the parents. The situation where the child lives in place B while the mother lives in place A while the fahter is willing to take care of the child is not tolerated. A judge will than let the father take care of the child.

Maybe but at this time no-one knows what the OP does in Thailand, does he work, will he also be away from the place where the child is, or is he retired or rich and has the time to spend with the child.
