Work permit is in process but will not be ready when non b runs out this Thursday..son Was only allowed the 90 days.

What is the best way round this?

Does a trip to Malaysia needed for another non b.. As with rules changing.. All confusing..

Is there anyway of a extension?

From Police order 777/2551

2.24 In the case of an alien visiting a Thai spouse or child:

Permission will be granted for a period of not more than 60 days at a time.

(1) Proof of relationship.

(2) In the case of a spouse, their marital relationship shall be de jure (legitimate) and de facto.

He has two children but not married. Only Thai buddhist ceremony..

DOes that mean he can get 60 days from Phuket or Malaysia and can he then get a work permit while on a 60 day visa

If not married then you have to be a Thai Court Appointed Legal Guardian of the children to get the National Police Order Case 2.24 60 day extension.

Also if you friend could get the 60 day 2.24 extension - Phuket Labour will not issue a Work Permit against it and he would thus need to leave the country anyway to get a new Non Immignt 'B' Visa.

Best option is a new 90 day Single Entry Non Immigrant Category 'B' Visa, your friend needs to go into Phuket Labour with a Thai speaker and explain the situation - if the WP is actually in process they will be able to issue a 'Letter of Acceptance' which can then be used at Penang along with the other required paper work listed in the link below to get the new 90 day Non 'B'

When will the work permit be ready? A couple of years ago, I got a 7 day extension because of work permit delay. It was a WP renewal, so may be slightly different.

If not married then you have to be a Thai Court Appointed Legal Guardian of the children to get the National Police Order Case 2.24 60 day extension.

Custody and legitimization from court is not required to get the 60 day extension at immigration It is only needed for the one year extension. As long as his name is on the birth certificate as the child's father he will have no problem getting the extension. He should have the child and their mother along with him when he applies.

Thank you for replies. Since writing here he seems to now have the necessary paper work to get a new non b.. And going to Penang .. Hopefully wp in couple weeks..

Phuket Labour will not issue a WP against a 2.24 extension even when it has been used to extend a 90 Day Non Immigrant Type 'B' Permssion to Stay.
