My Thai wife ws granted a UK Settlement Visa in March last year (dependant only on KOL as we've been together for 8 years).. She then passed her LitUkTest in Sept.

We had to return to Thailand end of November for various reasons, one being my wife's Thai passport was to expired in January, so she had to get a new one.

We return to the UK in just over a month and plan to apply for ILR then.

I have been assuming all along that her UK Settlement Visa in her old passport will be acceptable at UK Immigration. However, with things not always happening the way I excpect them on these visa matters I've just started to get a horrible paniky feeling! I thought I'd better check with you folks! Very grateful for your advice please.

No problem just take both passports.

You can get the visa vignette transferred to the new passport, but you don't have to and you pay to do so.

Speaking from experience a long time ago my wife never had a problem with the UK visa in an old Thai passport. The visa remains current despite the passport being expired. There is no need to get it transferred just make sure you have it with you.

On a separate note although having a European passport she always uses her Thai passport on re-entering Thailand to save paying for a visa here. On two occasions her Thai passport has been expired on re-entry here but it has never presented a problem.

Good luck with your wife's ILR which should be quite easy.
