If a person is claiming incapacity benefit, Housing benefit, child benefit, child tax credits and DLA would that have any effect on applying for ilr for his wife. He is not getting anything extra because of his wife due to her current settlement visa which was done before the changes so was pre july 2012.

The prohibition on certain public funds applies to the visa holder, not their spouse/partner.

So you can claim any and all public funds to which you may be entitled, provided you don't claim any extra due to your wife living with you.

Once your wife has ILR this prohibition is lifted.
