I have now Non O visa which will finish soon.

I divorced last year so when I apply for a new visa, what kind of visa should I apply.

We don't have kids together but I have property in Thailand.

So what category do I go in?

What kind of visa should I apply?

Thanks

Being divorced gives you no option for special consideration so a normal tourist visa unless you qualify for something other than divorce.

Do you have a visa or an extension of stay from immigration. If an extension you could be charged overstay from the date you divorced your wife.

If over 50 you could get an extension based upon retirement.

Go to school and study Thai and get extensions for that after getting single entry ED visa.

Tourist visas are the next option.

Your property gives you no rights to get a visa or extension of stay.

Hi arnondagan

I faced the same situation

I was on a NON O extension of stay based on marriage before and I divorced. When you divorce you need to know that your extension of stay is cancelled automatically, so you need to advise immigration right away. If you don't you are on overstay from the day you divorce. When you go to immigration they will let you apply for a 7 days extension for 1 900 bahts in order to leave Thailand and go to another country to secure another visa.

Personally, I didn't know this and I advised the immigration 35 days after I divorced. I had to pay an overstay fine of 17 500 bahts + 1 900 bahts for the 7 days extension. So close to 20 000 bahts in total. So I just hope you knew about this or you will face the same situation and you will have to pay 500 bahts a day for overstaying and this up to 20 000 bahts maximum. If is the case, just stay calm, go to immigration, explain your situation to the officer and the most important thing have the money ready to pay the overstay fine + 7 days extension. They will stamp your passport saying that you overstay your visa but it will also say that you cleared the overstay fine. You will be able to get another visa, so no overstress with this.

IMO, you should either go for a retirement extension if you qualify for this or an ED Visa if you have an interest in learning Thai language.

Good luck

You will have to pay the overstay fine as you didn't tell Immigration immediately when you got the divorce. If you can get the Retirement Visa pay the overstay but if you can't pay, leave the country and they will cancel your Non O Visa(marriage) thus saving you the overstay Visa and then re-enter on a Tourist Visa. This is only a suggestion and I don't know whether it is legal or not but perhaps there is a member out there who could advise if this could be done or not.

He is on overstay, so subject to a fine. The only thing that might happen is that they might not notice his overstay, but they might notice it at another time. For instance when he goes to immigration for a new extension and they question him about why not extending based on marriage.

We do not know what OP has - he said a visa so if actually not an extension of stay he is safe to remain until the 90 day period ends. If he had an extension of stay he was required to cancel it when divorced and would be overstay from that point. If found at border trying to exit on an extension of stay that should have been canceled he will be turned around to do so from recent cases. As to what percent are noticed have no idea. He gave no indication of being qualified for retirement extension.

When you get divorved how does immigation know you have divorced.

If you recently renewed the marrage visa for 1 year and then divorced shortly after, say a month. Before the 1 year period is up could you not simply use the time to put your affairs in order and then leave the country before the renual date. and no one would be the wiser.. Or does the divorce office notify immigration at the time of the divorce. Thank you.

immigration will not be notified of the divorce. But next time you go to immigration for an extension (for other reasons of course) they might question you and find out.
