LeCharivari Posted July 6, 2013 Share Posted July 6, 2013 Its all a bit open to interpretation ... but what it isn't is actual "marriage" as the wording was that the bill "confers social and economic rights and benefits of a civil union, free from discrimination", with the only proviso apparently being that gays registering a civil union must be 3 years older than those registering a marriage (18 with parental permission, 19 without, for civil unions, against 15 with parental permission, and 16 without, for marriages) and it doesn't confer adoption rights, apparently similar to the planned bill in Thailand. As such it doesn't breach the Constitution and may well stand, as according to a Supreme Court ruling in 2006 marriage was only between a man and a woman but civil unions between same sex couples would be legal under the Constitution if legislation for them was passed. Costa Rica's a pretty staunch Roman Catholic country, OTM, but its quite strong on civil rights so although many may not approve of homosexuality civil unions will get a lot less opposition than marriage - conjugal visits for gay prisoners, for example, have been allowed since 2011 as a Constitutional right of equality so its quite possible that trying to reverse the new law could actually breach the Constitution.
