Hi all,

I'm in a complex situation (at least for me) and since i don't know much about visa here i would like to know if anyone here could help me.

I found out recently (1 week ago) that my passeport is expiring on July 19th 2013! I started to flip (my fault i know, should of noticed it earlier but didn't paid attention) so i went to Canada Embassy 4 days ago to fill out application and i gave them. They told me it could take up to 2 weeks but the problem is for the last year i was on a student visa and my visa expire at the same time. Now i'm scared to do a visa run to Cambodia or Laos cause they obviously won't let me back in (at least i think) with a 2 more days valid passeport... and i don't know if overstaying is a good idea either.

What should i do? is there anything i can do? (or if the Canadian Embasy can provide a paper so i can go to immigration and explain my situation or i don't know...)

Also, i would like to know what kind of visa can i make once i'm in another country. Usually i was always having the student visa but right now, i would prefer to make a tourist visa as i would like to go out of the country.

Any suggestions?

Did you ask your Embassy? They normally can issue an emergency passport/travel document that can be used to obtain a visa exempt entry to cover the time needed but if only two days paying overstay may be a better option - it is not a negative if you are not caught during an arrest. You sill have to visit immigration for transfer of passport information being on an extension of stay before heading to border to obtain a new visa exempt or a Consulate to obtain a tourist visa (if no longer eligible for student visa).

AFAIK, when a non-immigrant visa expires, you're given the 30 days stamp like those who fly in, kind of like a courtesy move, to let you clear up any leftover business and then move on/leave. Go to Immigration, see if they can give you that stamp early. Because when you get a new passport, Immigration will transfer the MOST RECENT, valid visa/entry stamp into your new passport. However, if you hand in your old passport before your student visa expires, and then it expires in the deadtime in between passports, immigration has nothing valid to copy over into the new one.

Another option, is to ask the embassy for an emergency travel document. These are usually reserved for travellers who have tickets booked, and then lose their passport. Although it might not be easy, I have no doubt that Cambodia/Laos/etc and Thailand (on the return) will accept them as valid travel documents, since it happens all the time. You don't need to tell them WHY you have a non-standard passport. So if the embassy will grant you one (providing, of course, you turn in your old passport), then you go vacation in Laos for at least a week, so that on your return to Thailand you have enough time on your 15 day entry stamp to get your new passport/copy over the 15-day entry stamp and be set to do whatever you want afterwards.

This is the problem with these damned Canadian passports and 5-year validity periods. :/

Ya well i'm 25 and Thailand was like for me the first travel that i did so during all those years that i haven't traveled i never really looked at the expiration date...

But you better bet i will start doing it by now lol

There is no 30 day extension provision. There is seven days allowed with an extension that is not approved but that would require a passport valid for that time which he does not have.

Visas are never transferred to new passports - he appears to have had an extension of stay and that information will be transferred without issues (other than overstay fine if he does not obtain other document) - transfers are normally from an invalid passport to a valid one.

If he has everything needed for student visa... Why can't he just go ahead and request new passport from Canadian Embassy.

Then take all the docs from his school along with receipt and copy of application for new passport down to immigration for extension of his student visa?

Well the reason why i wouldn't want to renew a new student visa right now is because i just can't afford it atm (my school is 24k B) which is the reason why i would like to have a tourist visa for 3 months or something like that so i can keep saving some more to make a new student visa asap

Cost 260 $ CAD for 10 years.

Now all Canadian passport have 36 pages.

Your embassy should of given you an emergency passport or some other document.

The moment your passport expires you are in the country illegally. You must have a valid passport or travel document while you are here as written in the immigration act.

Not sure if Canada is the same or not, but for US embassy... If you need emergency travel docs because passport expired or lost...

The docs issued are only valid for traveling from Thailand back to US and can not be used for travel to any third country

If Canada is similar, then this will not help the OP

New ones are valid for 10.

Canadian diplomatic offices can, at their discretion, issue passports faster than the usual 20 day time frame, although "I forgot" may not pass muster as an emergency.

Not sure if Canada is the same or not, but for US embassy... If you need emergency travel docs because passport expired or lost...

The docs issued are only valid for traveling from Thailand back to US and can not be used for travel to any third country

If Canada is similar, then this will not help the OP

The US can issue an emergency passport valid for up to one year and clearly state so on there website. It can be used for travel to a third country but requires a valid reason for issue.

EMERGENCY PASSPORTS
Emergency passports are issued on a case by case basis, and are valid for three months up to one year, depending on circumstances. Presentation of evidence, such as a flight itinerary will be required for proof of genuine need for an emergency passport. Emergency passports require a minimum of 24 hours to process. We are prohibited from adding additional visa pages to an emergency passport.
PASSPORT EXPIRATION DATES
Please be aware that many countries require six full months of validity remaining on a passport in order to issue a visa upon arrival. Boarding may be denied at the airport for travel to third countries from Thailand, and travel back into Thailand if -there is less than six months validity remaining.
