Black list from Thailand and properties...assets...bank accounts

Featured Replies

Hi,

I have a question. If someone is black listed from Thailand, what about his assets in Thailand as condominiums, bank accounts etc...?

Could he sell his condominiums or transfer the property to another person or all his assets will be confiscated?

Thank you

Why would they be confiscated? Only in certain cirmcumstances like money laundering or drug trade crimes could assets possibly be seized. Or if their are liens against it and you don't pay back the loan/debt, eg. bank holds your mortgage, or title of your car.

I would suggest you'll never see a single Baht returned to you.

Immigration blacklisting has no effect on your ownership rights regarding assets in Thailand. It only limits your right to enter Thailand.

True that but then you would need to use a lawyer here to help you transfer, sell any of your assets such as condos, houses, businesses etc. Anything else you could either get shipped to where you are.

When I say "lawyer" I mean a good reputable one that would not scam you and all of the documents would need to be sent to you and have your original signatures etc. then sent back to Thailand as you will not be able to enter Thailand any more.

What country are you is your friend from and what caused the blacklisting ?

If it's just an immigration issue, the chances are that you your friend will not lose anything other than by normal thievery from unattended assets. If the immigration issue was triggered by some other issue, then it would depend on whether criminal charges are possible.

Well I would suggest if you find yourself blacklisted, it means you wouldn't have a single baht for them to take in the first place.

I remember many years ago a lawyer sugesting that if I wanted to protect my rights to stay in Thailand I should buy a condominium and then some sort of international law that ensures a right to access your property would kick in. However I never took it any farther. You are right some people can become jealous, and in my experience it is more likely to be a farang rather than a Thai. That is why it is better not to flaunt your wealth, just keep it to yourself.

It is not that easy to be blacklisted.

A person would have to commit and be found guilty of a criminal act. Most common would be drugs and then working without a work permit and etc.

You cannot be placed on the blacklist out of spite by somebody.

Sounds more like a real estate salesman than a trained lawyer. Any country can refuse entry to any non-citizen they choose, and regardless of whether they own a condominium or not. And conversely, being refused entry does not translate into having any of your assets in that country seized - the exception is when the assets were obtained illegally.
