Dear all,

I have a big headache after I get a Job in Thailand, I'd appricated for your hleps on this matter.

I am a Chinese native (Mainland) living in Thailand for past 5 years and using non-immigration ED visa now,I am still a student, and will graduated on sep, 2006, but i don't have to attend class any more. So I got a job offer from a reputed company in Thailand few days ago.But company asks me to change my Non-ED visa to Non-B visa in order to help me to get a workpermits and extent to be 1 year visa. Company will provides all the ducuments for geting a non-B visa in Royal Embessy in Beijing.

At this moments, I have time problem for doing this China, I would like to ask is this possible to do it in Immigration office in Bangkok??(my company will also support all of requeted documents) If, Yes, Is that legal?? and what type of Non-B I need for work permits and what type of Non-B could I get if i do it in Thailand without back to China?( Mutiple-Non-B or Single- Non- :o. How Do these two type of Non- B affect my workpermit and fututre extension of visa???

More to say, frinds tell me that Business visa and working visa is totally diffrent visa?? Is that right?? plz explain..

This is the information from Immigration web site for change of visa (to non immigrant B for work) inside Thailand:

DOCUMENTS TO BE SUBMITTED IN SUPPORT OF THE APPLICATTION FOR VISA STATUS ALTERATION (NON-B )

Application for Visa Status Alteration. (TM.86)

Copy of passport entries.

4 X 6 cm photograph.

Application fee of 2,000 baht.

Company letter requesting for Visa Status Alteration.

Employment contract. (Labor Dept.)

A letter of guarantee to certify commercial registration.

Company registration certificates.

VAT registration certificate and the lists of company Board of Directors.

The latest financial statement. (Balance sheets ; Profit & loss statement)

Company income tax or trading tax returns.

Documents providing evidence of education ; Job experience of foreign national.

Withholding Tax records.

BOI letter application for changing visa.

Remarks

The Applicant must sign every page of the application.

The Company Authority must sign to certify all documents and have them stamped with the company seal.

The visa applicant must arrange the documents in proper order and must prepare the originals as proof.

I have read Immigration web site for change of visa (to non immigrant B for work) inside Thailand couple days ago, and made a phone call as well. The things is that imformation Table told me that I could do it leaglly by having those ducuments. But I Called 02-2873101-10 ext.2237 got diffrent answers which must be done in China for a Chinese natives. Some l agency could help for this , but I have to pay a big money... I really have no idea what's the real rule for this matter...

More to ask, suppose i could change to be 90 days Non-B visa, and then could get a workpermits, after run out 90days non-B, what should I do on my Non-B visa and workpermits. ( Considered the 2 types of Non-B. mutiple entry non-B and single entry non-:o.. Do have still have to go out Thailand and back agin???

What you heard from Immigration should be what the story is as they run this system which is quite new. Often there are restrictions on what nationality can obtain what.

With a non immigrant B visa you receive a 90 day stay and apply for a work permit. After you get the work permit (assuming your pay is enough for your nationality) you go to Immigration to extend your stay for one year. When that is approved you go back to Labor Department to extend your work permit to match. It sounds worse than it is but I would probably use someone like Sunbelt if I were doing it for the first time. There is a lot of paper shuffling.

I suspect that you may have to make the trip to Beijing to obtain the non immigrant visa.

Even though you no longer in school, you still can apply for a work permit with this type of extension of stay based on education ( visa). Once that extension of stay expires in Sept.( as long as it still is valid, you left Thailand with a reentry permit) You simply then apply for an extension of stay based on business in Sept.

No need to change the (visa ) extension of stay based on education now.

Your employer is probably thinking we are nuts but have them call us. We guarantee this is correct advice and will work for you to get the work permit.

If they insist you change as they feel they know better, then you can do it in Thailand even if you are a Thai national. But their are hoops and couple documents they don't go into detail about on the governments web site.

This has to be the original diploma. Any letters of reference from employers for the past 5 years if they are not in English or Thai must be translated. But as I said before, this is not even needed. You are going to get a work permit without even do the change of visa( extension of stay based on education.)

If you do get the 90 day in China then be sure to put that visa # on your entry card and not your visa for education otherwise all your trouble was for naught. But even then you will still get your work permit as I have been saying, as it doesn't matter.

A lot of Thanks from your replaies..

I am now clearly understand the process on (step 1).Non-ED tansfer to 90days NON-B. ( step 2). Use 90days NON-B to make 90days Work permits (step 3). Extends to be 1 years Non-B. (Step 4). Make work permits to be 1 years which same as Non-B Visa...

My questions is that if on (step 2):My pay is not enough for my nationality, what probelm could be occur? (Does my comapny could do someting for it, I am sure my company aware that my pay less than that they have to pay)

I do know that 4 steps is complicated, but my company promise me they help me to do everything for me on (step 2) to (step 4) , but not (step 1).. But (step 1) already made me sick :D . It is hard to tell my company that:" Ok, you give me every ducuments I need, and I will pay for agency for doing every step by my self, sounds like i am not trust my company and looks like i am a rich guy....

One more questions, sorry! Suppose I extend to be 1 year Non-B and having a workpermit, Is this called "Working Visa" ( is this same things as 1 year non-B visa , and just a diffrent name??, and Are these all what I need for legally work in Thailand)

The normal procedure when pay is low you go with work permit to a Consulate and apply for a multi entry B visa and then have to make visa runs every 90 days and work permit change. Believe your company will pay you enough to avoid this (I would hope).

You can work on any non immigrant visa (except if obtained for retirement) but "B" is the normal visa that is referred to. There are two things that might be called one year - the above mentioned multi entry B valid for one year or the preferred extension of stay from immigration for one year. Only the extension of stay would be considered for PR application if that is what you mean - it is not really a visa but the term is often misused.

Unfortunatly, my company do insist me change to be Non-B before I start to work. Which means I have no choice, and I have really no time to go back to China to do so now. Company promise me to provide the all ducuments for this tansfering ( In Thailand).. But as you saied:"couple documents they don't go into detail about on the governments web site".

Suppose I am lack on few documents, Can I have done this transfer in Thailand by my self or by agancy.

And the Non-B what I get In Thailand and Non-B what I get in Beijing , are they same,(hear from a friend than 2 type of Non-B, mutiple entry non-B and Single entry Non-:o I mean that any affection on my next few steps such as extends to be 1 years and get 1 year work permits and so on...

Are you by chance going to be an Intern or trainee? If so and the employer will give you this letter confirming it. You can could get this change easier in this case. Otherwise it may never happen on the change of the visa inside Thailand. As you have to go thru Immigration. They will be concern that you are getting a salary lower than what you are suppose to as a Chinese national ( that will be the deal breaker by itself alone), you don't have job experience, you have only a high school diploma.

You will need to show the original high school diploma and letters from any employers. This will be needed. If you will be a trainee/ Intern, odds are we will be able to get around it.

If not a intern, then odds are you will need to go outside Thailand to get a "B" visa. You will only get a 90 day single visa. Once you get your work permit then you can go to Penang or KL( after getting a visa to visit Malaysia as you are a Chinese national), show your work permit and get a one year multi entry visa. You then just go in and out of Thailand at least every 90 days.

And the Non-B what I get In Thailand and Non-B what I get in Beijing , are they same,(hear from a friend than 2 type of Non-B, mutiple entry non-B and Single entry Non-:o I mean that any affection on my next few steps such as extends to be 1 years and get 1 year work permits and so on...

You will only get a single entry 90 day visa at a Thai Embassy outside Thailand in your case. As you don't get the minimal salary. You then will do visa runs every 90 days after obtaining the one year multi entry visa( after your work permit is obtained) You will not qualify to apply for the extension of stay based on business inside Thailand because of the salary unless you are an intern.
