I recently got sick and like to go home. Due to missing funds i had to let my visa expire for a bit over a year. On top of that my passport was gone. So i went to the embassy and they issued a emergency passport to travel home,

This passport has no visa stamps whatsoever, so now i have two options:

i can book a flight and show up at the airport (funds for overstay with me)

go to the immigration in bangkok and pay there.

The problem is:

My embassy tell me: they will arrest me right away. (42 day policy) then my ticket is invalid and i am stuck here forever.

i asked a thai lawyer: oh no problem! just pay. wait 24 h at your hotel and you have you passport back!

it was quite had for me to raise the funds and i can try only one time. anyone on this board share an ordeal like this in the last couple of months or so and give my advice?

any help would be greatly appreciated!

There is no 42 day policy there have been recent reports of people leaving with several years of overstay by paying the fine on departure. Your fine will be 20,000 baht.

Your problem is compounded by the loss of your passport. Did you make a police report when you lost it? Immigration will want to see it.

You could probably do it at the airport on departure but be prepared to have a long wait while they sort things out.

My embassy issued a letter that the document had expired and is unrecoverable. that should do it. not sure how the immigration will look at it. sorry about the wrong forum.

So it expired and you still have it along with TM6 departure card?

Having it will make it easier when you leave.

No. The passport is "gone" - the embassy just provided a letter to say it had expired etc

Do you by chance have copy of it. Your letter from embassy would lead immigration to think you should have your expired passport. Not having it will cause problems.

No. It took me quite a while until the embassy had figured out that i am a natural citizen of my homecountry and not an asylum seeker with perfect language skills sad.png

They had to pull a copy of the ordinal one and a birth cert from home.

Immigration will want to see a police report. Most embassies also have that as a requirement to get a new passport

Pay fine and apply for an extension to get 7 days to leave the country (1900 baht fee).

But they will certainly want a police report.

i have a passport. just an emergency one. return to your home country kind.

He meant your old passport. Without it or a copy they have to search for your original entry into the country.

Just spoke to the embassy - they gave me a 20 % chance than i can fly out directly. so anybody here has done it? the how is not really important.

Just curious,

In the OP's current situation, what are the chances of filing for a police report and getting out of the cop shop without being banged up just for being in his current situation?

Seems like quite a risk to reveal his overstay to the authorities before he's at the airport departure area, given his financial situation. Or is that a non-issue?

Normally I would not suggest it but since he lost his passport there is good chance they wouldn't do it at the airport. Immigration seldom if ever locks anybody up that voluntarily goes to them with money to pay the fine.

is that hearsay or your own experience? sorry, i dont want to be rude but i get so much controversial information about this topic.and i really don't want to try an IDC-thaivisa app sad.png

Over the years of reading reports about overstay it is my firm belief. You even had a lawyer tell you the same thing.

Why would they lock you up if you appeared with money in hand?

You could go to airport and try but what if they sent you back to immigration to sort it out
