Situation: My Immigration Thailand Re-Entry permit (Mulitple Entry) and Non O Extension of Stay dates are different because I have a new passport.

Old Passport expiry date was 13 Nov. 2013. Received the following in old passport. Extension of Stay permitted up to 16 Jan 2014. Immigration Thailand Re-Entry permit (Mulitple Entry) Valid until 13 Nov 2013. In April 2013 received a new passport and had the Extension of Stay and the Re-Entry Permit transferred to the new passport. 90 day reports were submitted when required. The next 90 day report was due on 19 Nov. 2013.

On 22 Oct. 2013 I travelled to Myanmar (Tachileik) from Mae Sai Thailand and returned the same day. Mae Sai immigration stamp shows Departed 22 Oct. 2013, then arrival stamp Non O – Re, 22 Oct. 2013 Admitted until 13 Nov 2013. When I inquired as to why I was not given 90 days or until the end of my extension of stay date of 16 Jan 2014. I was told that the date was based on my Re-Entry permit valid date of 13 Nov. 2013.

Plenty of conversation ensued and immigration was unwilling to change the admitted until date. I was told I would have to go to my local immigration office and have them deal with it. I have no idea what the outcome will be. What can I expect to happen? Will the local immigration office change the admitted until date based on my old 90 day report – due 19 Nov. 2013? Will I have to leave Thailand prior to this date and purchase another Re-Entry permit?

When they transfer a re-entry permit they do not change the date to the full extension date. You can try at immigration but you may have to start all over again by getting a new visa and extension.

Thank You Ubon Joe for the reply.
My current concern is that my new Mae Sai immigration stamp shows Admitted until 13 Nov 2013. This date was based on my Re-Entry permit valid date of 13 Nov. 2013 and not my (Non O) Extension of Stay date permitted up to 16 Jan 2014. This is what I don't understand, why wasn't my admitted until a date 90 days from Oct. 22 2013 which would be Jan. 20, 2014. Since my Extension of Stay is only permitted to Jan. 16, 2014 - that should have been the date used Jan. 16, 2014 - correct? It looks like I was given a 22 day stay in Thailand.

If immigration will not not change the entry stamp. You have to leave the country by Nov.13. They gave you that date because that is what was on your re-entry permit.

There is no reason for them to give you a 90 day entry since you don't have a visa for that long a entry.

For all intents and purposes your extension of stay is no longer valid because you now have a permitted to stay date different from it.

If immigration does not take care of it you will need to get a new non-o visa and apply for a new extension just like the first time you got an extension.

The OP chose to use a re entry permit the date of which was linked to the expiry date of the old passport. This has had the unfortunate effect of "re-setting" the permission to stay date.

Immigration were correct in using the re entry date of 13 Nov 2013 as in the absence of a valid visa they had no choice.

The OP can plead his case at immigration but I suspect, as Ubonjoe suggests, a new application will need to be made.

Thank You thaiexpat21 for Your explanation.

In regards to: Immigration were correct in using the re entry date of 13 Nov 2013 as in the absence of a valid visa they had no choice.

My passport has a stamp that says "extension of stay permitted up to Jan. 16, 2014." Is this not a Valid Visa?

It looks like a catch 22 situation, How can I make a new application for a new Extension of Stay prior to Nov. 13, 2014, when the one I have is dated 16 Jan. 2014?

An "extension of stay" is NOT a visa ! Your "visa" has expired.

To keep an "extension of stay" alive a re-entry permit is required if travelling out of country.

Your permission to stay date is now 13/11/13 NOT Jan. 16, 2014

Try your luck at immigration but be prepared to make a new application.

Making a new application means starting out with a new non-o visa or doing a border run and trying to do a conversion to a non immigrant visa entry at immigration.

Did you not notice that your re-entry permit was only valid until Nov. 13 when you had your stamps transferred.

Thank You thaiexpat21 for the explanation, getting closer.

To keep an "extension of stay" alive a re-entry permit is required if travelling out of country. Will I be able to obtain a re-entry permit that coincides with the extension of stay permitted up to date? Basically an extension of the re-entry permit to coincide with the extension of stay date.

Had I not gone to Mynamar, my next 90 day report was due on 19 Nov. 2013. Would the local immigration had told me then that I had overstayed based on the re-entry permit valid until date of 13 Nov. 2013? I was rightly or wrongly basing everything on the extension of stay date of Jan. 16, 2014.

Yes I did, the officer explained that the re-entry permit was based on the validity of the old passport dates. He said with the multiple entry, I could travel back/forth from Thailand as much as I'd like until the 13 November 2013.

My 90 day report stated my next notification was due on 19 Nov. 2013 - after the re-entry permit valid until date of 13 Nov 2013. Perhaps, immigration was going to tell me then that I had overstayed?

If you didn't had used your re-entry permit, your permission to stay untill Jan 2014 would have been valid.

As you left with a re-entry permit, you got a permission to stay upon returning till expiry date of re-entry permit. (If you had entered Thailand again after that date, you would have lost your extension to stay and only gotten 15 days). You have now only lost the permission to stay until Jan. 2014.

As said before your permission to stay date is now 13/11/13 NOT Jan. 16, 2014 the result of using that re-entry permit.

The best thing for you now is to discuss your situation with the immigration officers. They may be able to assist but, again said before, be prepared to make a new application.

Thank You Mario2008,

If you didn't had used your re-entry permit, your permission to stay untill Jan 2014 would have been valid. I'm starting to realize this was an expensive lesson.

Ok, what are my options now?

New re-entry permit to coincide with the extension of stay date of Jan. 16, 2014?

You could of gotten a new re-entry permit when you transferred your stamps that would of been valid until Jan. 16th of 2014. It is to late to get one now because you left the country and re-entered with an invalid re-entry permit

You would of had no problem doing your 90 day report. The re-entry permit date has nothing to do with it..

ubonjoe,

You could of gotten a new re-entry permit when you transferred your stamps that would of been valid until Jan. 16th of 2014. Unfortunately, this was not offered and the explanation given was - do all Your travelling and retrun to Thailand prior to Nov. 13 and there won't be a problem.

It is to late to get one now because you left the country and re-entered with an invalid re-entry permit. Wow, my Re-Entry permit still says its valid until 13 Nov. 2013. How can it be invalid now? I should still have my extension of stay valid til the admitted until date of 13 Nov. 2013. Hopefully, prior to the 13 Nov 2013 I have some options - like extending the re-entry permit date to match the extension of stay date of 16 Jan. 2014. Possible? Then a trip to Laos and a new immigration valid until the 16 Jan. 2014 extension of stay date?

You would of had no problem doing your 90 day report. The re-entry permit date has nothing to do with it. Lesson learned, hopefully this will help someone else.

Thank You Mario2008,

You will have to apply for a new 1 year extension of staybefore Nov. 13th. This is my best and cheapest option. I will make a trip to immigration next week.

Many thanks to everyone for all their input/assistance, much appreciated. Mario2008, Ubonjoe, thaiexpat21, lopburi - You do a great service to the expat community. Keep up the Good work!

My apologies for the late update. I went to the local immigration office and received a new re-entry permit to coincide with the extension of stay date of Jan. 16, 2014. Cost was 1900 baht.
