During late October 2013 I received my new passport from the UK which is valid from 11 October 2013. I renewed my passport as my old passport was nearly full. On the 11 November 2013 I contacted Udonthani immigration and had my extension based on marriage, my multiple re-entry permit and my last entry stamp dated 15 September 2013 transferred to my new passport. All three stamps transferred are valid until 06 August 2014. They also transferred some other entry stamps but not all??

The officer asked me where is your 90 day next report date paper that was issued to me when I received my extension based on marriage on 05 September 2013 and I replied that this was retained by Suvarnabhumi immigration when I departed Thailand on 09 September 2013. I informed the Officer that I believed my new next 90 day report would be 13 December (90 days after my last arrival in Thailand on 15 September 2013).

The Officer stated that this was no longer necessary and that we should report for the next 90 Day report on 09 February 2014. I politely stated that I believe this to be incorrect and that I did not want any issues with overstay. The Officer insisted that he was correct and that this would not be a problem; my Thai wife also explained in Thai to him however he still insisted and gave me a 90 day next report date paper for 09 February 2014.

Can anybody please explain this because both myself and my wife are totally confused.

Many thanks in advance.

If he gave you a new report slip I would not worry about it. I think he was just helping you by doing your report early to save you another trip to the office.

To avoid the overstay and to make it sure you should go to the immigration before December 13 coz sometimes the immigration officer write a wrong date. ( nobody's perfect ).... :)

This one did not write it wrong he just did the report early.

Also it is not an overstay for late reporting the two are not the same.

"On the 11 November 2013 I contacted Udonthani immigration ..."

As Ubonjoe said, he did the 90 day report for the O/P.

11 November 2013 + 90 days = 09 February 2014. It's not a wrong date. It's exactly 90 days from when he was in the Immigrations office.

All three stamps transferred are valid until 06 August 2014.

How can he be charged with over stay in December, 2013?

Since the office is fairly small and they do not have special ques for separate actions, he most likely used your visit as a 90 day report and reset the clock. My office resets the clock every time you visit for any reason. They don't make me fill in a new TM47, but they do staple a small piece of paper in the passport with the new date. He gave you a paper with the new date on it so you're good until Feb 9.
