I have been working for a BOI company in Thailand for the past year. I have a current work permit (to Oct 31) and Non Immi B visa to Oct 31. I recently resigned from my job, and my employer is requesting return of the work permit and my passport.

Question, I thought the visa in my passport is personal, and therefore, I do noty need to return my passport. I have been advised once I return passport and visa, once visa and wok permit is cancelled, I will have 7 days to exit Thailand.

Question, do I have to return my passport to my company to have my Non Immigrant B visa cancelled?

Can someone help me.....

If you have an extension of stay it has to be cancelled and you will have a week to leave. If you have just a visa and have been exiting country every 90 days it should remain valid. So it is up to what you have. Take a close look at your passport.

From the Oct 31 date it appears you have an extension of stay and that needs to be cancelled.

Actually my initial arrival date was around May 2005. The position I filled had an 'anniversary date of Oct 31 for the work permit. so although I resigned on May 3, my work permit is current and Non IMmi B Visa is current until Oct 31 2006.

I gave my employer 4 weeks notice, they paid me out and kindly said they will not request the return of work permit until the end of my notice period (June 3). So it looks like I have to leave within 7 days once my visa and work permit is cancelled..... is this correct ?

A visa does not allow more than a 90 day stay so you have an extension of stay and must now leave after it is canceled and obtain a new visa if you wish to return to Thailand.
