Delight Posted January 5, 2014 Share Posted January 5, 2014 The only long term answer will involve hard work by just a few of the co -owners.The answer is to organise an Extra General Meeting (EGM) and at that meeting replace the Juristic Person Manager(JPM) For this to be successful the building will need a suitable replacement JPM. Also at the EGM at least 25% of the total co -owner vote must attend (in person or by proxy). The vote to replace the JPM must be won and this vote must be at least 25% of the total co -owner vote. The actual first stage is to organise a co -owners meeting . Minimum 20% of total co -owner vote must attend(No proxies). The output from this 1st meeting is to 1) elect a special representative and 2) Send an Agenda for the forthcoming EGM to the current JPM. There are other rules concerning the detail of both these meetings- e.g. all official input and output documents must be in Thai language. From what you say your building is acting illegally. One of the functions of the JPM is to ensure that the condo and its management comply with the law. Yours appears not to care. You have to organize yourselves.you will need a Thai co- owner to help if you have a significant number of Thai co- owners. Fortunately we had someone who helped obtain all the email addresses for all the co- owners from the managing company. It is surprising how very apathetic some people can be. Also remember how many condos the co- owner still has ! It's illegal not to have an agm.?
