Hello to all who have helped me in the past, I have had 2 visas granted for my g/f without any hassles whatsoever, I now have my g/f pregnant and it is 5 months down the track, I am wondering would they allow my g/f to come to australia to give birth to our baby and stay another 3 months after the birth, My g/f was last here injanuary and i realise that they only allow a visa every calendar year or is that not true? If anyone can give me any advice i would be grateful for it as i dont want to apply for visa and they knock her back because they look on her documents later down the track and see she was refused .. They did tell my girlfriend they have no problems going to australia with me.. Thank you and hope to read some feedback... Tinytot

They will allow more than one visa per calendar year, but they do have a limit to the amount of visas issued per person and they dont say what that limit is. They are now currently issuing 12 month multi entry visas which allow for stays of 3 months only although the 6 month visa is an option.

I would suspect that they would not allow her a visa for the purpose of giving birth in Oz...For one you would have to foot the entire bill of the birth and secondly they would be concerned if anything was to go wrong during the birth and any ramifications that may arise from that.

They may also suspect that if she gives birth in Oz that you maybe trying to shortcut the system by having her give birth in Oz.

I would suspect that a visa application which will cover the birth period would in all probability fail

Officially, Immigration will inform you that there is no limit to the number of tourist visas they will issue. In practice, it is not so clear cut.

Again officially, you need a valid reason to visit Australia. If you apply for visa No. 3 and put 'touring' as the main reason, they may say that you 'toured' on the last two occasions and twice is enough.

If you give the reason that you want to travel to Australia to give birth, what reason would you have for returning to Thailand? It may be thought that with a new baby born in Australia, you won't be so eager to return home, particularly if the baby is under a doctors care whilst in Oz.

Graham mentions the ramifications of a Thai mother giving birth in Australia to a Aussie dad. Does that make the baby an Australian? I don't know the answer to that but it could complicate the birth papers.

From a medical point of view, I suggest that you also make inquiries about the dangers of airflight whilst pregnant.

Under the Australian Citizenship Act a baby born in Australia is an Australian if at least one parent is an Australian citizen or permanent resident.

Proof of parentage (DNA) may be required.

Thats my understanding of the act Old Croc....this is what I meant about shortcutting the system.

The ramifications of giving birth here relates more to any complications that could occur of a medical nature.

I would think that the Immi people would look very closely at any application in these circumstances.

The ramifications that came to my mind would be the welfare of the baby born in Australia on a three month T/V.

Once the three months visa expires, mum has to leave the country. How safe would it be for a baby, less than three months old, to fly home with mum?

Would the Immigration Dept take any responsibility if the baby was subject to medical emergency whilst in flight?

Anyway, I see that the OP has started another thread and decided not to bring his pregnant partner to Oz.
