What happens if wife dies?

The marriage extension loses its validity. You go to your local immigration and find out if you can qualify for another type of one-year extension. If you don't qualify, ask for a short extension on compassionate grounds, then before that extension expires, leave Thailand. If you wish to return to Thailand thereafter, get a visa depending on the purpose of your trip, eg tourist visa, etc.

Thai Police Order 777/2551 gives information about the various types of extension of stay available in Thailand.

That does suck...

Haven't looked at the links but I presume if you have children there must be an extension available on those grounds ??

I don't have kids and touch wood my wife will outlast me, but would they consider having a dog and geese as a good reason to issue an extension :)

I think (but not sure) you can apply for a retirement extension subsequent to the death of your wife. This would be done at your normal immigration office. You will need to ensure the correct financial requirements are met of course.

If you (in the name of your spouse) have land then it must be sold/given to a Thai national within one year.

If you have a usufruct agreement on the land document then that is transferred with the sale of the land and you are then entitled to live on, and enjoy the land until the usufruct time expires. Having said that you would then be at the mercy of your inlaws, new land owner and other villagers good will. You could find that to be in short supply. People can get very grumpy when inheritance issues etc. are raised.

So basically, if you don't have kids or are under 55, you are forced to leave and come back in on a tourist visa should you wish to continue living here !!!!!

It would be under 50. You need to be 50 or over to qualify for an extension based upon retirement.

A tourist visa or going to school would be about the only choice.

It is possible to get an extension of stay based upon have having a Thai child and there is no limit on the age of the child.

Do you have a link to a text that clearly indicate "No limit on the age of the child" ?

The one I was able to find mentiondd the child still being in school. In that case, what happen when the child no longer goes to school?

2.18 In the case of being a family member of a Thai national (applicable only to parents, spouse, children, adopted children, or spouse’s children): Each permission shall be granted for no more than one year.

(1) The alien must have been granted a non-immigrant visa (NON-IM).

(2) The alien must have proof of relationship.

(3) In the case of spouse, the relationship must be de jure and de facto; or

(4) In the case of children, adopted children, or spouse’s children, said children, adopted children, or spouse’s children must not be married, must live with the alien as part of the family, and must not be over 20 years of age; or

(5) In the case of parents, the father or mother must maintain an average annual income of no less than Baht 40,000 per month throughout the year or must have deposited funds of no less than Baht 400,000 to cover expenses for one year. For other necessary cases, the Commander or Deputy Commander of Immigration Bureau is granted the authority to make decisions regarding approval on a case-by-case basis.

Thanks for mentioning the usufruct, I had never heard of it before but after a search on the net it sounds very usefull for the future.
