Jatuporn should just take a leaf out of Sutheps book and postpone the case himself on the grounds that he is too busy protesting to appear in court.

So. Yin unlucky appeared in court and was removed from office.

But all the other folk accused of corruption and murder etc, make excuses to avoid appearing in front of a judge

Is it just me? Or is it fair to say that the government in waiting is the only power following the law, whilst the opposition break the law with impunity.

Im not making a statement.. Im asking a question, because I'm in and out of Thailand all the time, and this is awfully confusing as it seems that yinluck is following/ bowing to the law, whilst the bully boy anarchists are giving the law the finger.

I know some of, a lot of, posters follow this closely, so i would sincerely appreciate an explanation on this matter, as it seems farcical to me

Jatuporn appears, arrest warrant revoked

BANGKOK: -- The Criminal Court yesterday revoked an arrest warrant issued earlier in the day for red-shirt leader Jatuporn Promphan after he came to testify in a case where he is accused of defaming former prime minister Abhisit Vejjajiva.

The court revoked the warrant after Jatuporn arrived at the court at 1.30pm and explained that he had no intention to delay the trial.

He is accused of defaming Abhisit during rallies in October 2009 when Abhisit was the prime minister.

Jatuporn told the court that he did not attend the morning session because he feared for his life. He said he had learned that anti-government protesters would rally at the court in the morning.

After hearing Jatuporn's explanation, the court asked him to testify at 9am on Monday.

Is there any out there left with out arrest warrant against them?? it seems that every

political man and his dog have been issues with one of those...

One more time double standard.

The Royalists committed dozens of crimes since 2006 (no need to mention them again) => still at large and even making more troubles in the country (i.e. Suthep).

Some guy like this Jatuporn just spoke against a criminal and he should be in jail?

By the way, this is EXCELLENT => the proof that the justice is always on the side of the aristocracy against the population.

Continue like that and there will be no more aristocracy soon.

As a Newbie I gather you have spent a lot of time getting up to speed on the situation and on the political players in Thailand?

Furthermore Abhisit has been accused of a crime but not even PTP during their time in government had the audacity to push for a court hearing. Therefore he and anyone else that has not been convicted is innocent until proven otherwise. Maybe the country you come from does not operate that basic right?

Jutaporn was convicted and is out on bail and breaking the conditions imposed on him too.

It also appears that you do not understand the words aristocracy or population. Maybe a good idea would be to consult the OED before posting garbage.

I would have thought the lawyer would have requested the Court to postpone any defamation hearing until AFTER they know whether Abhisit is actually guilty of anything or not.

Jatuporn should produce evidence that Abhisit ordered the killing of red shirts.

Well, the DSI thought there is sufficient evidence on which to base murder charges against Abhisit. Why does this not suffice?

Every time there is a murder reported here at TV and someone is charged, people talk of the accused as if he's already been found guilty. Are all those posters liable to be charged with defamation also?

That's really not the point, is it? You said that Jatuporn should produce evidence of Abhisit's complicity in the use of live ammunition on protesters. My reply was that there is apparently enough evidence to charge Abhisit.

Do you not see the paradox? That there is enough evidence to press formal charges but anyone who makes the same accusations as represented by those charges is somehow guilty of defamation... makes no logical sense.

Anyway, it's all moot now as the arrest warrant has been apparently withdrawn

The Attorney General decided on the prosecution, not the DSI.

BANGKOK - Thailand's attorney general has decided to prosecute former premier Abhisit Vejjajiva and his ex-deputy on murder charges related to a bloody crackdown on anti-government protests in 2010, officials said Monday.

Abhisit, who is now the opposition leader, and his former deputy Suthep Thaugsuban ordered security forces to reclaim areas of the capital and allowed authorities to use arms, said Nanthasak Poonsuk, a spokesman for the attorney general's office.

"Evidence shows that their orders caused others to carry out murder and attempted murder as charged," Nanthasak told reporters.

The case will now be referred to a criminal court which will decide whether to put the pair on trial.

I didn't say anything about "complicity".

Jatuporn said that Abhisit ordered troops to kill red shirts. Jatuporn should be able to produce evidence of this order, regardless of whether the arrest warrant has been withdrawn.

Jatuporn’s lawyer, Mr Banyat Chartmontri, told the court that his client was afraid to show up for fear of his safety and, therefore, he asked the court for the hearing to be postponed.

Jatuporn is on trial in a defamation lawsuit filed against him by Democrat party leader Abhisit Vejjajiva. The UDD leader was said to have accused Mr Abhisit, then prime minister, of ordering the killing of red-shirt protesters in May 2010 and blocking the attempt to seek amnesty for fugitive prime minister Thaksin Shinawatra while addressing red-shirt crowds during October 11-17 in 2010.

Abhisit’s lawyer rejected Mr Banyat’s request for the postponement of the hearing.

The court then said that Jatuporn’s claim of concern for his own safety was unacceptable and was deemed a deliberate attempt to delay the case. It issued an arrest warrant for Jatuporn with an instruction to his lawyer that he be brought before the court on May 26.

The Attorney General decided on the prosecution, not the DSI.

and the Court accepted the case as one that should go to trial.

Would that be the Attorney General that reports to PTP's Justice Minister? The one who dismissed terrorism charges against Thaksin, despite the widely seen video evidence, because he was "out of the country at the time? Or was it is successor, who promised to review this decision and is obviously taking his time.

Cannot charge someone if they are out the country at the time of the offence. Cannot charge someone with perjury if they lie to the court but are only a witness not the defendant. Issue a passport illegally, the AG and DSI won't care. Welcome to the creative and strangely one sided view of law and justice practiced by Thaksin proxy parties. We right, all else wrong.

Let's see what happens to the murder charges lodged against Yinngy, Chalerm etc now.
