June 1, 201412 yr Thai woman married with Aussie man in Thailand. Having 1 kid 4 years old, on birth certificate Australian guy is the father. Relation is going downhill and father not putting any efforts into getting his child a Australian passport. They never registered the child at the embassy Can the mother get this done (Australian citizenship for the child)by herself? And if what should she do? Mother is just a friend.
June 1, 201412 yr Mine is not a definitive answer for you as I truly don't know. Two months ago, I registered our Twins born in Thailand with the Australian Embassy as I am an Australian Citizen and my Partner, Thai. 'Registered' means they are acknowledged as Australian 'Citizens by Decent'. One of the documents required was my birth certificate, an original or certified copy. As for the child's birth certificate, anyone's name can go on that. Under Thai Laws, because they were legally married (presumption) the Thai Law presumes that he is the Father. Australian Law, to my knowledge, doesn't make that assumption. So, to have the right for an Australian Passport, you must first prove to be Australian. For the child to be proven Australian, the child needs an Australian Citizenship document. That's just my understanding, hopefully others will have had the practical experience.
