Hi all!

My friends' working visa is expiring in 14 days. She has a thai partner, they live and have a daughter together. We are hoping someone might have been in the same situation and be kind enough to share some infos for the following questions:

1. Is it possible for her to get a Non-O visa from her daughter?

2. What are the requirements?

3. Which office should she go to?

Positive responds are most appreciated.

Yes a non immigrant 'O' Visa as the Mother of a Thai child is possible, as is an Extension of Permission to Stay based on Thai Family as below wil be available from the Mother's local Thai Immigration Department:

National Police Order 777/2551 Case 2.18

In the case of being a family member of a Thai national (applicable only to parents, spouse, children, adopted children, or spouse’s children):

Each permission shall be granted for no more than one year.

(1) The alien must have been granted a non-immigrant visa (NON-IM).

(2) The alien must have proof of relationship.

(3) In the case of spouse, the relationship must be de jure and de facto; or

(4) In the case of children, adopted children, or spouse’s children, said children, adopted children, or spouse’s children must not be married, must live with the alien as part of the family, and must not be over 20 years of age; or

(5) In the case of parents, the father or mother must maintain an average annual income of no less than Baht 40,000 per month throughout the year or must have deposited funds of no less than Baht 400,000 to cover expenses for one year. For other necessary cases, the Commander or Deputy Commander of Immigration Bureau is granted the authority to make decisions regarding approval on a case-by-case basis.

There are other options including the one at a time 60 day Case 2.24 'Visiting Thai Family' Extension as well.

In order to get the one year extension of stay requires the parent applying for it to be the legal parent of the child by way of marriage or legitimization.

It is possible to get a 60 day extension to visit the child with just the birth certificate and the house book showing the child in it.

A single entry non-o visa is also possible with only the parents name on the birth certificate.

Since the OP is a "she" and must have had the child, does she still have to legitimize the birth? She obviously is the legal parent!

In this case it would be to prove the father is Thai rather than being the legal parent. I think I wrote legal out of habit.
