Hi,

I need some help about applying for my visa and work permit. My Thai language skill are not good enough to communicate with my schools HR department properly and I'm becoming anxious.

Last week I was told that I needed to go to Laos to get a non-o visa based on marriage. Which I did, then back in Thailand I handed my passport to my HR dept. and thought at least this is all finished now and I can await my work permit...WRONG.

Now I'm being told by HR that they need to extend my visa as it's only 3 months, I informed her that it was actually a 15 month visa (multiple) and she said no it is 3 months. (Oh she also told me that my wife needed to go to Savannakhet which wasn't correct and she gave me a wad of documents including salary slips etc none of it required.) I think she means apply for an extension of stay, before I get my work permit.

To be honest, I know she's trying hard to help me, she is new in this position and is pretty inept. There have been numerous mistakes, she even went to the wrong booth at CW and we lost our place in the queue.

My questions;

1.My non-o visa is a week old and my stamp runs to October, can I apply for an extension of stay now? Is it necessary to get before work permit?

2. My wife's house register is in Pathum Thani, do we apply for an extension at Cheang Wattana or Pathum Thani? She told me yesterday at CW.

3. Do I need the extension before I can get my work permit? On a list I saw it said one of the requirements of extension is that I have a work permit.

4. If extension is needed before work permit will my wife need to go to CW/PT immigration with me?

5. Please could I have a list of the required documents for Pathum Thani immigration? Their website is all in Thai language.

1. You can get the extension during the last 30 days of your permission to stay. It is not necesarry for you to have an extension before you can apply for a WP.

2. You apply where you live. If registered in Phatum Thani it will be there, unless you and your wife have rpoof (rental contract) of living in BKK.

3. Apply for the WP now. Without it you are not allowed to work and will not get an extension based on work.

4. If wife needs to go with yu depends on which reason you extens tyour stay: if based on work she is not needed, if based on marriage her pressence is required.

5. List depends on the reason you apply on the extension.

So, she or I can only apply for an extension at the start of the 11th or 14th month? It is a multiple entry non-o.

Is there any government website that states this? I want to to be able to show her that she is doing this process wrong.

Since you have a multiple entry non-o visa you don't have to get an extension unless you want to. You can get an extension of stay during the last 30 days of any of the 90 day you get from your visa you do not have to wait for the visa to expire.

I think the lady at school does not realize you have a multiple entry visa. Her comments about you only having 90 days is in reference to your 90 day permit to stay from your visa entry.

If you your income is 40k baht or more you can apply for an extension based upon marriage. If not not you could apply for one based upon being a teacher.

No there is no specific webiste that states it. But she can contact the labour department, she will ned forms from them anyway.

Thanks for you info.

I have a meeting with her today, she would like to explain the visa process to me. I would just like to be clear on two more things.

1. To extend my visa based on marriage I need 400,000 THB (Don't have) or a minimum income of 40,000 baht I month, which I have. But surely immigration will observe that the income comes from the school and then lead onto the fact that I dont have my work permit yet = a problem. Correct?

2. To extend my visa based on work I need a work permit. So it's not possible right now.

Yes. They will want to see tax documents to see if you paid your taxes, often immigration will also want to see the WP.

A border run would be better if you need time to get the paperwork in order.

It's strange that your employer asked you to get a O visa based on marriage and not a B business visa. It sounds as if they did not have their company registration and tax documents available or they have no intention on applying for Work Permit for you.

Giving them the benefit of the doubt, DO NOT put your faith in the hands of the HR staff of any company. Find out the procedure from immigration, then request the information from your employer. Any mistake from your employer about visa or work permit matters and guess who ends up receiving the fine, or being deported. (Clue: it's not the HR girl that was taking care of it)

Usually the 12 month extension is granted once the Labor Dept issue approval for Work Permit. You can also get extensions of stay while waiting for WP to be approved, but these are typically just 7(?) days . This process may be easier at the BOI one stop center,

Yes I agree with Time Traveller regarding his reply stating how strange it is your employer got you a NON-0 as apposed to a NON-B. Very strange indeed.. Perhaps you could enlighten us as to why your employer felt the need to do this?

Also surely showing your income from the school to immigration, whilst not having a work permit is a bad idea right? It's perfectly feasible for them to wish to see your (currently non existent) work permit in order to extend your visa based on the school income, no?

Good luck my fellow human being, these are difficult times for many of us with families in Thailand.. Let us hope and pray that we can all continue to reside here in this beautiful land, without being scrutinised by thai officials with their bureaucracy and sometimes corrupt ways.

Mario your advice on visa issues is awesome (as is Ubonjoe).

I need to get an extension of stay for retirement shortly from a non-imm B multi-entry.

Above you state "..You can apply for the extension during the last 30 day of any stay,,". Does this mean I have to apply in the last 30 days of my 90 day stamp?

If so this is a major problem for me as I am rarely in the country for more than 30 days let alone 60 days. If it is the case I have to stay over 60 days are there any exceptions/way round this?
