I'm a little over 60 days overstay and am awaiting my citizenship through my mother who is thai but now resides in America.. the process is taking longer than I expected. I got a double visa before leaving America in January and did a couple visa runs but my visa just ran out 2 months ago. should I leave before 90 days to avoid being banned or is there a way I can pay the fine and get another visa, perhaps a work visa or visiting family visa?? OR if I leave before 90 days pay the fine when is the earliest I could return? or would I have to wait for my thai passport and citizenship?? can I get any special treatment for applying and awaiting citizenship?? thank you!
You should leave asap.

Come back preferably with a non-O visa obtained by showing your Thai birth certificate, if you have it already.

Once in country you can get an one-year extension again based on your Thai birth certificate.

If you don't have the Thai birth certificate you have the same other options like a foreigner.

Your application for Thai citizenship ?the fact that your mother has Thai nationality should be enough to get an extension of stay from immigration. You only need to show that your mother has Thai nationality (copy passport should do plus birth certificate).

 

Talk with them, but your best option might be leavening, paying the overstay fine and just return to Thailand and from now on get extensions of stay from immigration.

 

If they can give you a note for the border checkpoint that you have an application for Thai citizenship running it would be handy.

To be clear, how are you 'applying for Thai citizenship'? The first step will be you apply for a Thai birth certificate. If born in Thailand you will already have that and you just have to apply for a. ID card and then passport.

If you were born in there states you need to have the Thai embassy in DC issue a Thai birth certificate.

I have a legit company in bangkok doing everything for me.. we sent everything over to the US for a thai birth certificate, but my mothers names didn't match on her thai passport and thai ID card so now there's a problem that's lengthy & costly to fix.. we can use my thai grandmother apparently but the cost is out of my reach...B70k!!! I will ask my lady doing my paperwork about some documentation stating I'm awaiting citizenship... thanks guys!!

The department of consular affairs on chaeng wattana rd has a desk which liaises with Thai embassies abroad on issues exactly like yours. You should work with them as they would be much better skilled at sorting out these little problems.

I doubt a letter will help your visa issues however.

I think that if the OP could obtain a letter from the dep.t of consulate affairs as mentioned by samran, that would help with either obtaining a non-imm O visa, then 180 days or one year extension.
