I have almost completed 3 months of studying Chinese on an ED visa, and I intend to apply for a 12-month visa extension on the basis of having a Thai son.  (I am old enough to apply for a visa extension on retirement grounds, but I am not retired, and may want to apply for a WP in the future).

 

Although I am not legally married to the mother of my son, we were legally married prior to his birth, but divorced a few years later.  So I have copies of our marriage certificate and the original of the divorce certificate.

 

- Both my ex and I look after our 8-year old son (we live in properties 100 metres away from each other).

- I have 400k in the bank

- We can provide ID card, tabian bahn books etc

 

I hope to extend my visa at Phuket immigration office.

 

I have checked relevant threads about this topic, with the most relevant being from 2011.  So I want to check if the rules/document requirements have changed since 2011.

 

 

The most important doc you need is a cert from the Umpur legally registering you as the father. A birth cert is insufficient because a woman can declare any man to be the father.

 

You have to go with your ex-wife and kid to the Umpur to do this. Takes about 30 mins but your kid must be old enough to speak and understand Thai.

He was married to his child's mother which makes him the legal father of his child. He does not have to legitimize his parenthood.

You will need your divorce certificate showing at least joint custody.

Your child will need to go with you when you apply.

You will need to have 400k baht in a Thai bank in your name only or proof of 40k baht income. Although not required by the rules you may need the money to be in the bank for 60 days to satisfy Phuket immigration's requirements,

You will probably need photos of your and your child together at your house. There will also be home visit.

You should check with Phuket immigration to find out what their requirements are.
