Is possible to Get Marriage Visa and keep the Work Permit?

Featured Replies

Hi All,

Just got a new Work Permit based on a Business Visa that allow me to stay in Thailand 1 year.

I would like to know if would be possible to keep valid my new Work Permit with my actual company (BOI Company) if I get a Marriage Visa

My idea was to ask for the Marriage Visa once I qualify for it by myself, without inform my company about it, because I don't know if they

would like the idea that their brand new farang employee can just quit at any time, once my stay in Thailand don't depend of their Work Permit.

I hope my question may be of interest for others.

Thank you all in advance for your help.

You can have a WP on an extension of stay based on marriage.

But you talk about a BOI company. If you extend based on marriage, you might need to go BKK-immigration (presuming you live there) and cannot use the service of the one stop service center. I am not sure about this, so check with them.

My Work Permit was done in the One Stop Service Center, and there also was extended my Visa,

does it change something?

When I asked the lawyer of the company about this, also mention to me that the company was BOI

And what is the trouble with the BOI thing ?

Not a problem with company having BOI privileges.

The one stop center may not do your extension based upon marriage. They might only do extensions based upon working.

If that is the case you will have go to CW.

Thank you for your answers.

The lawyer told me since my Visa was extended at the One Stop Service Center, I would have to go there for the notifications too, so will ask

about this issue next time if finally get the requirements for the Marriage Visa.

But keep in mind that if you lose your job, you can always apply for an extension of stay based on your marriage at that time without the need to leave the country. So you are not dependent at all on them for your stay.

It just means a little running around and hurrying if you lose your job to get the paperwork in order.

Yes, I think will do as you comment, will keep using my business visa and work permit, because anyway I need the salary.

And when I finish or loose job with this company will get  the marriage extension to apply later for the marriage visa before next job.

Just for your reference, there is no such thing as a 'marriage visa'.

A One Year Extension of Permission to Stay within Thailand would now fall under National Police Order 327/2557 Case 2.18 - In the case of being a family member of a Thai national (spouse).

Else outside of Thailand you could obtain a non immigrant 'o' visa based on proof of marriage to a Thai national.
