Surrogate mum would be charged double if baby imperfect

BANGKOK: -- As part of the surrogacy scandal involving a Japanese man, a young woman from Udon Thani province agreed to bear a child in order to help her parents escape the clutches of loan sharks.

Pat (not her real name) was promised Bt300,000 for the job.

However, the contract that she signed also said that if she delivered an "imperfect" baby, she would have to care for it herself and pay Bt600,000 in compensation to the contractor - Japanese national Mitsutoki Shigeta.

This was how Pat's aunt and grandmother described the surrogacy service.

Pat, who has just turned 21, delivered a perfectly healthy baby. The infant, named Mitsushita, left Thailand on March 25 with Shigeta for a future that Pat knows nothing about.

An ongoing police investigation suggests that Shigeta, 24, left Thailand with a baby in his arms at least four times in recent years, with the declared destination being Phnom Penh.

Records show that he had proper documentation to take the children out of the country.

Shigeta attracted media attention after he was identified as the father of nine infants discovered at a condo in Lat Phrao earlier this month.

But he flew out of Bangkok early on August 7 - as soon as the police began looking into his case.

General Jarumporn Suramanee, a top adviser at the Royal Thai Police, said latest lab results show that of the nine infants, six baby boys are brothers and three baby girls are sisters. However, another test is required with a sample of Shigeta's DNA to find out if all nine babies are related.

"An additional test can be conducted to scientifically confirm whether Shigeta fathered all nine babies," Jarumporn said.

Police also need to find out why Shigeta decided to have so many babies via surrogate mothers here.

At present, Thailand does not have a specific law to govern surrogacy services.

However, the Medical Council strictly bans commercial surrogacy, and doctors found to have violated this regulation stand to lose their licence.

"According to civil law, a baby born to a surrogate mother is her legitimate child. But, she can give her child up for adoption," Jarumporn said.

However, he pointed out that many social problems and health risks could follow if surrogacy is not addressed properly.

When contacted, surrogate mothers of the nine babies have refused to provide details about their deals to the press, but many revealed the name of their agent - a half-Thai, half-Indian woman with the nickname 'Na'.

The agent has admitted recruiting surrogate mothers for a firm, but denied being involved in Shigeta's case.

Most countries' governments care about the welfare of their children. One particular South East Asian country doesn't care at all about their children.

Those seem like two distinct issues:

- Is commercial surrogacy legal
- Is shaking down poor people and, not only cancellign a contract, but actually shaking down the girl to pay money TO the surrogate parents

On that second count, please let me know if you all need any help "interrogating" the nice gentleman with the contracts.

Yes of course that contract would be totally unenforceable; and sadly there are no laws here to enforce against this form of trafficking either.

one has to wonder if the 600k imperfect baby clause did not originate from the thai side of the business?  if the contract was in thai then the japanese guy may very well not be aware of it. i could see the thai faction coming up wit such a clause.

If true, I can only imagine the worst for these poor newborns - otherwise why would a Japanese guy take multiple babies to that country?

Sadly, sounds like he's selling the kids in Cambodia....ugh! What an ugly world we live in. The poor in Thailand, not only preyed on by the elite and the police, now preyed upon by rich parasites from the developed world.

What is worse potentially, and I sure hope he's not been involved in such, is babies procured purely for organ transplants. I was horrified when I googled such, as it is still a huge business...... it's beyond belief. I live in hope that this Japanese guy is for real, and he is a rich businessman wanting to give a good life to kids via his earnings.... yet, there's something just not right about this case. Until we know a lot more about his business, and his intent (and if his business and riches have not come from baby trading), I feel very uncomfortable about all involved in this - there is something so largely amiss here and I feel not reported. We can live in hope that his intentions are pure, yet (and I'm placing a guess here) I don't think many posters at TVF would rest assured that there is NOT something largely amiss here. :(

Maybe for the stem cells. To harvest them from the babies and use them later to make new organs for himself.

the downfall of the free visa's for thais to japan ... just enough time to go deliver the baby and collect the cash

wouldn't the genes of the actual parents  determine this ?

There's a larger likelihood his body would reject such, if his own sperm etc. has been implanted to surrogate mothers, so guessing his intent is not down that avenue. Yet, we're advancing silly projections we hope are not true, without supporting evidence of any sort - guess it's best left until we find his real intent/s.

This is absolutely outrageous.

 

These unscrupulous people are treating human babies as if they were puppies being bred as pets to be sold into family homes, using a female to give birth and studs to sire the mothers and rejecting the babies that the buyers consider as having imperfections. There is also the fact that surrogate babies are bypassing the legal adoption processes that means they could be homed with couples who are totally unsuitable and not befitting to be parents. As a matter of fact this whole practice of what has become commercial surrogacy or wombs for hire for the highest bidders is sick and beggars belief that such inhumane activities are actually happening.

 

There is an even darker side to this, that these babies could be used for diabolical medical practices, such as body parts for transplants and those that are born with mental or physical defeats or even the wrong sex could be discreetly disposed of.

 

This vile practice has to be clamped down on with immediate affect and any males and females that contribute to surrogacy for profit and gain should face the toughest penalties as criminals because these cases can be described as crimes against humanity that does not belong in the civilised world. 

Humans have been doing it to animals, in particular dogs for years, the sick and disgusting practice of puppy mills to supply the pet store chains supply demand, scary to think it's now being revealed to being performed in Thailand with human babies for who knows what end market.

Make some very clear laws on this and put an end to it.
