I will be returning to Thailand with my family in November for approx. 5 months. My son has both thai/irish passport but my daughter has only irish passport. Can she re-enter Thailand on irish passport and leave with new thai passport obtained while in Thailand? She was born in Thailand and exited with irish passport.I cannot get thai passport in Ireland as no embassy here, would have to travel to uk with her, which would entail bringing her mum who would have to apply for uk visa etc etc (getting complicated/expensive).Suggestions please??

She'll need to exit on the Irish passport if that is what she enters on.

For the next trip here, have her use her Thai passport to enter and exit.

If your child enters on a their Irish passport they must also leave on it. But will not pay an overstay fine.

You might want to check with the honorary Thai consulate in Ireland or the embassy in London to find out when there will be a consular visit to Ireland to apply for the passport. But it would take almost 2 months to get the passport.

Unfortunately getting a new Thai passport for my daughter here in Ireland or the UK is not going to be possible in this instance. She will enter Thailand on her Irish passport and get her Thai passport there.I'm now looking for the simplest/cheapest way for her to stay for 4/5 months in Thailand. If she gets a holiday visa can she apply to get an extension of stay based on being a Thai national?or is there some other option open to me???

She can get a one year extension of stay at immigration based upon being Thai.

After you get her Thai passport she could also leave and re-enter using her Thai passport. It is best to do this by air because it is virtually impossible to it at a border crossing because they look for entry/departure stamps for the other country there.

Thanks Ubonjoe, I think a single entry holiday visa then apply for extension will be best in this instance My daughter is only 7 months old so flying out/in or doing a border run would involve dragging the whole flying circus with me!! Plus we live very close to Cap Choeng immigration so I guess I can do the extension there?By chance do you know the cost of such an extension?

As an aside I was refused a non Imm O visa this year based on having two Thai children, a visa I received several times previously but due to recent changes in law I no longer qualify as I'm not married to their mother,so back to holiday visas for me !!

She could enter on with no visa and get a 30 day visa exempt entry that could be extended for a year. The fee for all extensions is 1900 baht.

Since you are close to the border you could also have her mother take her to the crossing after getting her passport and talk to immigration about doing the crossing. They might let her do it and it would cost nothing since both of them would get a 14 day exempt entry to Cambodia using their passports.

You can still get a single entry non-o visa based upon being the parent of a Thai with just her birth certificate showing you as her father. You just cannot get a multiple entry. If you got a single entry non-o visa an then applied for a 60 day extension to visit your child that would give you almost 5 months without needing to leave the country.

You should have your parenthood legitimized by way of a Thai court. See How To Gain Parental Rights As A Father

Thanks Ubonjoe for the info,I'll try the border idea with baby and mum ,nothing to loose as living 30 mins drive from border!! On my visa issue,I spoke to Thai consulate in Dublin and embassy in London this morning and was told I would not get a non o visa either single or multiple entry and would have to get a multiple tourist visa to facilitate my 4/5 month stay.!!

I can recall people getting a single entry from London with just the fathers name on the birth certificate. Perhaps they have changed.

A single entry tourist visa would give 4 months with the 60 day extension to visit your child.

The previous non o visas were granted on this basis of which I had three.l asked if the rules had changed since I received my last non o and was told these rules always existed ,ie married to mother of children or being legal guardian. The fact that I had received non o visas previously based on being named on their birth certs was due to these parameters not being enforced !!
