Koh Samui public prosecutor has returned the police case file on Koh Tao murder back to the police with a demand for additional interrogation of the Rohinya interpreter employed by the police.

The public prosecutor’s latest move followed complaints from the parents of the two arrested suspects who claimed that the suspects were beaten up by the interpreter to extract their confession to the murder of two British backpackers on Koh Tao in mid-September.

Rohinyas and the people of Rakhine state of Myanmar do not get along well with each other and are hostile toward each other. The two suspects are ethnic Rakines

Earlier the KohSamui twice asked the police handling the murder case for additional evidences about the case. This was the third demand from the prosecutor.

This is what, the second time the prosecutor has sent the brief back to police asking for more information. At least one person in the chain of this investigation understands how important this trial is going to be.

Very glad to hear that, but am still surprised because usually police/prosecutor/judges in Thailand seem to be, how shall I put it, not stepping on each others turf.

It is the 4th time the prosecutor has returned the case!!coffee1.gif

Unlike some posters here, he doubt the standard (or lack thereoff) of the work by the police force!!

Can someone educate me please, what if the prosecutor is still not satisfied will the case be dropped? Who decides this ?

if the case is returned 5 times .. it migth become "dead" .. and the Burmese guys has to be freed.

There doesn't appear to be a solid case against the rwo Burmese suspects. No way would they keep returning the file otherwise. This case has me torn. My hunch is that the two Burmese lads are innocent, but if their sperm is in/on Hannah then it has to raise doubts. Massive doubts. If it is sperm from the accussed, we haven't heard them saying the RTP extracted it from them have we?

I think what people need to know is the type of DNA found. Was it 'touch DNA' or sperm/skin inside Hannah's fingernails etc.Sharing a cigarrette doesn't prove much, unless the suspects denied ever sitting with her on the beach. I would smell a rat if that was the case.

One thing I will say is this...the person or persons that raped Hannah was also the killer (or one of the killers). Some (unbelievably) seem to be in denail about that. Sure, it's possible, but pretty damn unlikely.

Also, he can see that the brown stuff has already hit the fan and doesn't want to get caught up in the fallout if it can be avoided.

I read somwhere they have to be released after 84 days if they are not charged by then. Every 12 days the police have to ask the prosecutor(?) for another 12 days of arrest

Six years on this site and nothing has ever wound me up as much as this case. The brutal crime and shear incompetence of the authorities, then add to that a sprinkle of obsessive and many times manic posters jumping on every post which dares to question the system.

I refuse to get drawn into the merry go round of this freak show, however I must admit this brings a big smile to my face.

I think I just commented on the Banana Pancake man and his necessity in this operation, on another thread - nice to see the prosecutors agree with me clap2.gif

So the prosecutors still arnt comfortable theres a solid case, not surprising but 4 times returned now speaks volumes.

We are firmly making our way back around to square one....

Sad as that may be its preferable to a slam dunk, scapegoat, case closed option.

Its looking more and more like the killers and rapists are still out there, chances are if not caught they will hurt people again.

I dare say the UKP are working quietly from scratch anyway looking at everything and everyone on their own merit. It will be interesting to see how things go if we do end up back at the beginning.

Those who have been quick to praise the RTP and claim its been a perfect investigation are going to have a hard time defending the glaring truth that its been a farce from beginning to end.

Will Pol Gen Somyot now take tough legal action against the prosecutor for distorting the case against the Burmese? cheesy.gif

The RTP place all the blame on him, release the current suspects and (depending on how much the UK police know) either arrest the real perps or leave it as an unsolved crime. Not ideal, but better than admitting the RTP engineered it.

I believe it is 84 days (7 lots of 12 days) and the court has the authority to release them.
