Malaysia says MH370 crash an accident to clear compensation

KUALA LUMPUR, Malaysia (AP) — Malaysia's Civil Aviation Authority has officially declared the MH370 crash an accident, fulfilling a legal obligation that will allow efforts to proceed with compensation claims.

Malaysia civil aviation chief Azharuddin Abdul Rahman said Thursday that the search for the Malaysia Airlines jet that disappeared on March 8, 2014, "remains a proiority."

In a pre-recorded message broadcast on Malaysian television he said "it is with the heaviest heart and deepest sorrow that we officially declare Malaysia Airlines Flight mh370 an accident."

He said all 239 passengers and crew on board are presumed to have lost their lives.

Bangkok: -- Family members of the 239 people on board Malaysia Airlines flight MH370 have vented their anger after Malaysia declared the disappearance an "accident" despite that the world's greatest aviation mystery remains unsolved after 328 days.

"They are lying," said Sarah Bajic, whose American partner Philip Wood was on board the plane.

"It could very well be that the plane crashed. But there is no evidence and until there is evidence we just can't believe them," she said.

"It is impossible to bring closure until we have proof."

Malaysia deserves credit.

Its declaration of the MH370 crash as an accident is a humantarian gesture solely to allow the process for insurance compensation claims by survivors. If it otherwise delayed such a declaration, the survivors will remain in an indefinite litigation limbo and some may suffer financial difficulties. This action doesn't prevent a continuing search and investigation into the causes for the crash nor pre-empt a subsequent finding that might contradict the crash as an accident. So what's the problem?

If it otherwise delayed such a declaration, the survivors will remain in an indefinite litigation limbo and some may suffer financial difficulties. This action doesn't prevent a continuing search and investigation into the causes for the crash nor pre-empt a subsequent finding that might contradict the crash as an accident. So what's the problem?

Well if that is the reason well fine and commendable.

But the fact is that the Malaysia's Civil Aviation Authority , Malaysia's Airline Operations, Malaysia's Milatary Air Operations and other branches of the Malaysia goverment bungled this incident from the very beginning and have been trying to cover up their incompetence ever since.

As such it is unlikely that MH370 will be found. By comparison the search area for Air France 447 in 2009 was approx 5000 sq miles but took 2 years to find the Wreckage and millions of dollars. They found 447 on what was to be the final attempt.

The search area for MH370 is some 10 times the area for 447 approx 50,000 sq miles.

So do the Math and who's going to pay - Malaysia?

To find MH370 will require someone to get very lucky.

Without finding the Wreckage the mystery of this flight will not be resolved.

All that is known is that the aircrafts Transponder, ACARS, Radio were disabled and subsquently went through 2 course changes.

Why or how is just speculation without finding the crash site.

KUALA LUMPUR (AFP) - Malaysia on Thursday formally declared the passengers and crew of missing flight MH370 to be presumed dead, a step that it said opens the door for compensation payments but which was angrily rejected by distraught relatives.

Malaysian authorities and the airline had until now refrained from drawing firm conclusions about the fate of the plane and its 239 passengers and crew, as many desperate next-of-kin continue to insist it may have landed safely somewhere.

But Thursday’s declaration that MH370 was an "accident" was essentially a formal announcement that the plane had indeed crashed somewhere after its disappearance on March 8 and that all aboard had perished.

"It is therefore, with the heaviest heart and deepest sorrow that, on behalf of the government of Malaysia, we officially declare Malaysia Airlines flight MH370 an accident," civil aviation chief Azharuddin Abdul Rahman said in a televised announcement.

"All 239 of the passengers and crew on board MH370 are presumed to have lost their lives," he added.

Urging relatives to move forward, he said it was "important that families try to resume normal lives".

Malaysia Airlines later said it would begin contacting families to proceed with a "fair and reasonable" compensation process.

But Sarah Bajc, whose partner Philip Wood was on board the plane, was one of several relatives who poured scorn on the announcement.

For the families of 239 people it's a tragedy, not an accident.

They want answers to why the transponders were disabled and why it changed course twice, which I find hard to believe was an accident.

I don't think the families are concerned with compensation claims at this particular point in time.

The plane has disappeared into the ocean and otherwise didn't go down in the most populous part of the planet and hit the land. So i'd say its fair to call it as lost with all missing presumed dead. Its been 10 months and it has yet to be found, where is it supposed to be nay sayers?
