Hi,

My current situation is I have 2 children with my thai wife. We are applying for her spouse visa. Our children have a thai and british passport.

The unsure points in her visa application are accomodation and my finances.

I have a 2 bed contract with my mothers house plus letter from my mother explaining we are welcome and can't wait to see us, no one stays there. I will say that I will commute to the place in Lancashire where the house is rented as I live and work in Aberdeen. For the time being as we want to find a house together in Aberdeen and live there in the near future.

I am currently employed by a company in Aberdeen since 01/09/2014 and am now on an internation al assignment in Norway from 01/11/2014. I will return after the assignment on 01/04/2015. I earn more than 50k a year and get paid into a British bank. Is this a problem the visa. I have a letter from the company explaining my circumstances and I will return to work in Aberdeen. I will have 6 months bank slips from 15/02/2015 but the income goes up due to extra allowances. I will explain them.

With regard to the accommodation; not a problem, though a formal tenancy agreement between you and your mother may cement this.

You are employed by a UK company (on PAYE?) and your salary paid into a UK bank.

Can you provide pay slips, bank statements and the other evidence required by salaried employees specified in the financial appendix?

If so, I can't see where you actually work being a problem; especially as it is only a short term assignment. Indeed, I don't see a need to mention this at all.

I have a formal tenancy agreement.

To say nothing about Norway, how do I explain my salary increase as I work offshore in Norway plus on my bank statements it will show money being put into my Norwegian bank account. I pay PAYEE and NIC. I can provide 6 months slip and bank statements. I was paid into a different bank on my first month. So I assume I will need to provide 6 months bank statements for this. Plus I have been supporting my wife and children through another bank account and I assume I will need to show this one as well. I will give a letter from the HR of my employer who specify I earn 40k a year.

Just to confirm I don't need to be working for more than 6 months?

As you said in your OP "I earn more than 50k a year and get paid into a British bank." I assume you mean you are paid into a UK bank, and then transfer some of this money to your Norwegian one for your day to day expenses.

However, I think you will still be ok if you have been with your current, UK based employer for more than 6 months and are based in the UK albeit on temporary assignment in Norway.

A simple covering note explaining this should, I think, be sufficient.

But I would like the opinion of someone with more expertise in this area than I; such as Tony M.

With regard to your bank statements; 5.6 Specified Evidence in the appendix says

5.6.1
2. In respect of salaried employment in the UK (except where paragraph 9 applies1), all of the following evidence must be provided:

© Personal bank statements corresponding to the same period(s) as the payslips at paragraph 2(a), showing that the salary has been paid into an account in the name of the person or in the name of the person and their partner jointly.

Which to me means you only need to provide statements for the account(s) your salary has been paid into over the last 6 months.

However, I would also provide the others as they will show the monies you have been sending to Thailand to support your wife and daughters and so be evidence of the continuing relationship.

If you are relying on UK salaried employment you need to have been in that employment for at least 6 months prior to the application; though not necessarily with the same employer.
