February 10, 201511 yr Left Thailand from Suvarnabhumi on the 17th January 2015, but I should have left on the 24th October 2014. Paid the 20,000 Baht overstay fine, signed the receipt and boarded the plane back to the UK. I kept quiet and polite and it went smoothly. Received a stamp in my passport (see scanned copy) and as far as I can see, I'm not banned from re-entering Thailand because I didn't break the 90 day overstay rule - am I right? I understand that entry to Thailand is always at the discretion of the Immigration Officer and that my overstay was a bad move, despite my impeccable record over the previous 3 years.
February 10, 201511 yr You are not banned. The rules you mentioned have not been approved or applied. Admission to Thailand is not simply discretionary but based on certain known rules and policies. When you return to Thailand it may be expedient, but not necessary, that you do that on a new passport. Edited February 10, 201511 yr by paz
February 10, 201511 yr When you return, you will have no problem with this, whatsoever. With the same passport. Even if you did have a longer overstay. Just come back in with at least 10.000 bath in your pocket, and you will be safe.
February 10, 201511 yr As said there is no ban for overstaying for more than 90 days. That was never approved by a higher authority. That is the standard overstay stamp.
February 11, 201511 yr No problems with the overstay I have 4 overstay stamps one 9 month one 3 month and 2 one days and still have not problems and before some self centred opinionated member tells me how discussing I am for breaking the rules Please go ring someone who cares. Overstaying was not something I wanted to do it was just bad planning . Edited February 11, 201511 yr by goonnerone
February 11, 201511 yr As many have pointed out in previous posts, the best bet for your next return is to get your tourist visa in advance from the Thai embassy in your home country. This will (hopefully) prevent any surprise upon arrival at the airport.

February 11, 201511 yr Some at the British Embassy have reported a 50/50 chance of leaving without any problem after a long overstay. I do know of a small number of people who have been sent back to sort out some irregularity at Immigration head office. I think the OP saying, be polite, quiet and compliant is excellent advice. Do this and 90% of the time it will work out for you. I recently worked with a Koh Tao refugee that had overstayed more than 6 months and had to leave on an emergency passport. The Embassy called through to Immigration at Suwarnapum and cleared the way so there was no problem. This is an option for you. If it is a loooooooong overstay and you are concerned about the potential for problems with your departure from the Kingdom, get your embassy involved. One day it will not be so easy, so get your visa sorted out right now, while you still can!
February 11, 201511 yr Just another data point. I have a one day overstay in 2012 and I have traveled to and from Thailand twice since then with no issue at all. One thing on the politeness factor. I had my one day overstay and took a mini van visa run to the Poi Pet crossing. The Young Thai lady was very nice. When she asked me what my job is back in the USA and I said I was an engineer (in Thai) it was fun. We chatted a bit as she rifled through my passport. I said I was just on an extended vacation and I had trouble getting from Phuket back to BKK in order to get a new visa stamp exemption so I was one day late. There was only one other person in that overstay line so the stress level was pretty low that day on everybody. Smile, be pleasant and wait until they call you. It reminds me of once upon arrival at BKK airport while waiting in the immigration line, this black lady from the USA stepped out of line, moved the stanchion over with the rope in front of a booth that she presumed the Thai officer was going open. He was not opening anything and was simply in there collecting some paperwork.
