Work permit expiration while on holiday

Evening, have a bit of an interesting one. Just got an email from my HR that my work permit is due for renewal next week. I am, however, currently on 2 weeks holiday ( I was under the impression it expired at the same time as my EOS which is August). Anyway, has this happened to anyone before? HR have said they will contact the department of labour to see what they say. Anyone had a small extension given before? I am loathe to ruin my holiday by having to fly back to Bangkok to sort it but I guess I may have to.

If your WP goes one day beyond expiry it is to all intent and purpose lost.

However, your employer can file a part complete application on your behalf plus can get a WP5 Renewal receipt listing as to what is outstanding and as to how they have to stump up said items.

Do this and you are completely safe and still 'in the system'

This is often referred to as 'booking a renewal', it costs 100 THB and definitely should be done before your expiry date is reached when the hit-the-fan.gif

Seems to be what happened. They just said to lodge the docs when I get back

Not sure if this helps, but the last time I was at the labor office was in 2007 when my current WP was initiated. All the extensions since then have been done by the company. All that was required from me was the signatures on the application (not sure what the form number is) and on the relevant copies of the passport pages. Company provides the rest of the documentation.

Should be able to get your HR to send you what needs to be signed and scan them back?

Spot,on I think they already have all the photo copies etc. It didn't see like a big deal. They just said they would sort it when I get back to work. If I have to work out of the Hk office I do not really care it it sounded like it all was ok

Just wanted to update. Renewed the work permit for 2 years even 7 days after the expiration date. Seems as long as the docs are in order it can be done after.

Maybe that's the case at your particular Labour Department, however the general rule is that one's WP dies the day after renewal is due unless:

1) All papers are filed before the renewal date.

2) Part papers are filed and a WP5 Receipt is issued, with extra requirements noted, before the renewal date.

If the above is not the case for you then:

1) Your company has an exceptional relationship with Labour.

2) Your local Labour department is not familiar with the regulations.

3) You got lucky.

4) Somebody begged.

5) There was movement under the table.
