Hi everyone,

I'm preparing the documents for the ministry of labor for the WP1. On the list of documents to provide they are asking to fill out the power of attorney page and I don't understand what this is. My employer should fill one and me too.

Is this document only if you take an attorney to take care of the work permit process? is it mandatory to take an attorney?

I printed all the documents, now I'm with my employer preparing everything then once completed I will go myself to bring the complete file to the ministry of labor.

So how to fill this power of attorney page?

Should indicate where I'm currently working but I resigned from my previous job already, other thing it states "to be lawful and legal attorney for the purpose concerning with work permit"

Does it mean that he is granting me to be his attorney? then I have to make one page where I am granting him my attorney?

Doesn't make sense, I'm really lost.

I suppose that by attorney it just mean that I'm authorized to submit some documents in his behalf.

or this is if we are using an agent / lawyer to take care of the process. So if I'm doing it myself, should I get one from my employer only, still don't know how to do concerning my current position and location of my work as I'm unemployed

It authorizes your employer to submit the the application, other documents and sign forms on your behalf.

In position of refers to the person you are authorizing to do the application for you.

So I am the grantor and he is the grantee. Should we both make one? one where I'm the grantor and another where he is the grantor.

Also can I bring all the documents myself to the ministry of labor or does my employer has to do it?

If you do it all your self the power of attorney would not be needed. I think it would be best if your employer did it for you.

he is a bit busy, he doesn't have time to go to bangkok, so he will prepare all documents needed on his side but I will bring the file myself to the ministry of labor.

So there is no need to provide power of attorney?

I'm there and they are saying that I need to submit the WP3 the WP1 is only for those who already have a non B visa. So I have to go outside the country and wait there until to get the letter after my boss submitted the WP3.

Form WP1 states that you must be on a non immigrant entry, so if you are on a Tourist Visa, or a Visa Exempt entry, then they are correct.

However, there is nothing to stop your employer filing a WP3 application and supplying a copy of your passport ID page, the application would be filed as 'awaiting non immigrant 'b' visa and the letter of acceptance could then be obtained, after which you could then do your visa run.

Your employer should file the WP3, not you, as WP3 is filed by the prospective employer for someone who has 'not yet entered Thailand'.

Problem is that they have already seen you and could well insist you follow the letter of the law.
