Thai citizenship for child born to non-Thai parents who later acquire Thai citizenship?

Featured Replies

Hello,

I do not seem to find an answer to this question anywhere on the internet.

If a minor child (below 18) is born to non-Thai parents and one of the non-Thai parents later acquire a Thai citizenship, can the child get Thai citizenship automatically or are there any other conditions to be met for him/her to acquire Thai citizenship?

Would appreciate any views / comments / suggestions on how to make Thai citizenship possible for a child of a non-Thai father who later acquires Thai citizenship.

Regards,

SB

I don't have a definitive answer, but would say if neither parents were Thai citizens at the time of the child's birth, then there is no claim to Thai citizenship. of course one could argue the child is a dependent of someone who is a Thai citizen by naturalisation but somehow don't think this would fly

this question would need to go to a lawyer

I assume that the father will need to apply for citizenship for his minor child. It'll probably take the same time frame as usually the applications made by wives of thai citizens i.e. few years . There's no automatic thai citizenship for the child.

If both the parents are permanent residents, which they'd need to be if they are in the way to cotizenship, then the child is automatically a Thai citizen by birth.

The only way to skip the PR step is to request citizenship via marriage to a thai spouse, which doesn't appear to be the situation here given neither parent is Thai.
