My apologies if a similar topic has been posted, I have read through various forums but founds mixed messages with regards to visas.

I am currently working at a school in Thailand. The last few teachers to give notice to the school when leaving have not received their final salary. I am going to be leaving very soon myself and do not want my owed salary to be stolen from me as well. To this end I do not plan to give the full 1 month notice as it is almost certain I will be working a month for free if I do that. My question is what are my options at this point. If I do not have a termination letter from my employer am I going to run into problems when I go to cancel my work permit and/or leave the country. Although I do not plan to stay in Thailand, I would rather not burn bridges with regards to getting a visa in the future if I decide to come back at all. Many thanks in advance for any advice!

The teachers that did not get paid their final salary should make a complainant to the Labor Ministry.

You can cancel the work permit yourself. Without a termination letter you will not be able to cancel your extension at immigration.

If you are flying out of the country you will not have a problem if you do not cancel your extension.

Make sure you leave on payday at the end of the month.

Some agencies do it to philippino staff regularly..

I wouldn't tell them I'm leaving if there was any chance of losing wages

As a previous head of school the rules regarding foreign teachers leaving without the correct notice was that they had to pay the school 3 months salary since their have been many changes in this sector maybe maybe this ruling has been rescinded

FYI ~ The LOS is not Japan! 1. ~ Do not give the school any notice. 2.~ Keep your mouth shut; do not discuss your intentions to leave, especially with colleagues of the same school. No matter how chummy your "on-the-job" relationships may seem be, colleagues are not friends. They will gossip among themselves, in your absence. Guaranteed there is always one farang "snitcher" in every group of NES teachers. 3.~Quit the job while taking a 3-day sick leave (after receiving your last paycheck). 4.~ Leave Thailand during that 3-day timespan, but cancel your work permit on the same (Friday is best), and depart the same day, if possible.clap2.gif

I have no problems with what you want to do - do a midnight flit after your last pay cheque. I have seen this many times, and yes, you are right some schools may not pay that final month.

Presumably this is the end of your first semester of the contract and the school that is currently paying you for the mid-year holiday ? 4 weeks at full pay as a benefit for completing the year. I guess that doesn't count right ? Your not ripping off the school at all ?

Good luck enforcing that in the labour court, if standard notice period is 1 month you would be in breach of standard labour rules and schools are not excempt, if the pay cycle is 1 month, then 1 months notice would be customary and anything would be deemed unenforceable further there have never been any rules which state 3 months

And the "Head of school" does not know the difference between 'their' and 'there'.

This could be the last resort, I'd say. Maybe I'd do this if I shouldn't come back to

Thailand to work again.

One of the best ways is to inform your school that you're going to leave in a month

as soon as you've got paid for March. Most of the schools in Thailand will be closed

till the middle of May. You can officially leave your school and Thailand at the end

of April or in the beginning of May. If you shouldn't get paid for April, you won't have

to work and can stay in Thailand till the day of resignation. You can travel in Thailand

then if you like.

Or you can negotiate with your school director and ask them to prepare the paper

for you to go as soon as you've got paid for March if you want.

When I came back from BKK on the Sunday afternoon I realized that he had left as his things (and some of my) where gone, all together it's about 10,000 he owe me.

And as he did not give his notice the school did not have time to find a new teacher so I ended up having to take his classes so that the students would have a teacher.

Quit at the beginning of the school break (April/October), that way you can just walk away without caring. That is how I did it because then the school have time to find a replacement and the students don't loose any teaching

But I guess that you are to greedy to lose 1 month salary as you would be out of work for 1 month!

What does your contract say ?....if it says 1 month only give them a month, what happens if they find a replacement quickly and want you out straight away...trust me these things do happen....dont ever give anything away....if your contractual obligation is only 1 month only give a month...simple

Perhaps you need to work on your reading comprehension and not tarnish everybody with the same brush. Why am I greedy to not want to lose my salary for the month that I have worked. The management in my school has not paid the last few teachers after they have handed in their notice. I have worked in the same school for 3 years and I have been a model professional for that time. If I hand in my notice, work for my final month and then the school don't pay me I will be getting screwed out of a months salary that they owe me. I guess you would just work for free and suck it up... yeah right!

And what was the reason for not paying they gave ?.....if money is being withheld they are in breach of the labour laws and someone could take them to the labour court and they will win

Yes, just comply with your contract.

The second term is quite short, if you give the school an idea that you are making a move a month or two before the year ends, you don't say this but I just presume ( which is a critical time with assessments and exams looming ) they may be inclined to ask you to go now.

I have seen it before with my own eyes, a young and naive couple gave a well known company 3 months after returning from the mid-year break, thinking they were being helpful and they were dropped after the next payday.

Although we think we are all invaluable, the school doesn't care - often like other posters have pointed out, the first thing the HoD will get asked is if the position can be left open until next year to save some cash, then your colleagues will be asked to cover to your position to complete their maximum contact hours, other times the non-native teachers will be threatened into taking your teaching hours, with the promise of some OT payment.

If the school did not pay what you are legally entitled to receive a simple complaint made to the Labour Office would soon ensure their mind set was adjusted.

Leaving without notice is IMHO not "professional".
