If you haven't the cash to pay the 20,000 fine and are prepared to spend a bit of time in an IDC centre then it is cheaper so I am told from someone who did just as you say. he also said he wouldn't do it again so up to you as they say here. if you can get the 20,000 and a ticket just rock up and fly out without any problems. Oh and be prepared to get a load of crap from the holier than thou posters telling you that you are evil personified and making it oh so harder for everyone, though none of them has ever told me how this is

Don't even try and convince yourself that IDC wont be as bad as you think it is......do whatever you can to pay the fine and fly out then and there.....

True you cannot turn yourself into an IDC but you CAN turn yourself into BKK immigration as my friend did. BKK immigration then place you in an IDC till they take you to court. my friend was fined 1200 baht for his overstay and when he had a ticket was taken to the airport and placed on the plane. This took 4 days in total. As said he said he wouldn't do it again just to save the money

My advice would be to borrow the money to pay the 20,000 and a ticket out.

You better hurry up and find yourself the 20k or you could find yourself in jail for the next 100 days (200 baht/day) if what I read in the newspaper today passes and becomes law.

^ If (a big if) it passes there'll be a 60 day period before it actually goes into effect, that's how it usually works with ministerial changes. Not much of a hurry.

In response to the OP paying the 20k is better, then you can control the cost of the flight, i.e. could be a cheap low cost airline to an Asian country. If you go to IDC the 20k fine will likely be reduced to around 3k or so but then there are extra charges for the airport transfer, and they'll pick an expensive last minute flight back to your home country.

Sounds like a terrible life to me but I guess they have their reasons not to go back.

I know I found it totally devastiing when I had to leave my boyfriend and return to my 'normal' life back when I was 22 or so and visited Koh Samui for the first time for a couple of months. Not just so much for missing the temporarily love but more so that I hated to go back to some shitty job again and live the 9 to 5 lifestyle, which feels more like being jailed, eat/sleep to be able to work, and work to be able to pay bills. That's what you get when you're uneducated with some poor paid job and real estate prices through the roof.

However that is a comparison of 3 months non stop party with plenty of money for the time being vs hardly getting around.

If the comparison would be scraping for a living in the heat of Thailand, not being able to do anything due to constant lack of money, only sitting on my bud all day long and being frowned upon by locals who definitely recognize you as some leech then I think I'd rather opt for going back as there's one thing that I hate even more and that's wasting time with zero progress. Miracles don't happen and especially not when being broke in Thailand.

I am a firm believer in luck in the way that you can force your own luck by taking action, hard to do that when you can hardly afford a bowl of rice.

I know people similar as OP and these often turn out to be people that have no friends or family left for support because they've been borrowing non stop and received plenty of second chances and instead of using the help to return they just used it up to extand their stay in the magical Kingdom of Thailand lol.

PM Prayuth to decide on tough new penalties for foreigners who overstay

BANGKOK:-- Prime Minister Prayuth Chan-o-Cha is considering whether or not to introduce new, stricter penalties for foreign nationals who overstay in Thailand, according to Immigration chief Pol Lt Gen Nathathorn.

Pol Lt Gen Nathathorn told reporters on Sunday the new rules on overstay being considered by the PM are as follows:

For an offender who cooperates and hands him or herself in to Immigration:

• 
  Overstay of more than 90 days = barred from re-entering Thailand for one year.

• 
  Overstay of more than 1 year = barred from re-entering Thailand for three years.

• 
  Overstay of more than 3 years = barred from re-entering Thailand for five years.

• 
  Overstay of more than 5 years = barred from re-entering Thailand for ten years.

For an offender who is arrested for overstaying their visa:

• Overstay of less than 1 year = barred from re-entering Thailand for five years.

• Overstay of more than 1 year = barred from re-entering Thailand for five years.

These penalties were first proposed in 2014 after Immigration officials informed the Interior Ministry that the existing penalties for overstay, which include a fine of 500 THB for each day of overstay, up to a maximum 20,000 THB, were not enough to deter people from overstaying in Thailand.

Currently people who overstay their visa can simply pay the fine and immediately return to Thailand.

The new, tougher penalties, which have been approved by the Interior Ministry, have been passed to PM Prayuth for his approval.

In 2013, more than 70,000 foreigners were charged with overstaying their visas.

Pol Lt Gen Nathathorn was speaking at the conclusion of the Immigration Bureau’s “Good Guys In, Bad Guys Out” operation, which resulted in more than 9,000 foreigners being held for overstaying their permission to stay in Thailand.

You are still posting advice based on Immigration law being changed by an elected legislature.

This is not the case in Thailand any more.

If you note, although it was the Immigration big wigs that were making the formal statement of pending changes to the handling of overstayers, they are quoting Prayuth per se, "Pol Lt Gen Nathathorn told reporters on Sunday the new rules on overstay being considered by the PM are as follows:..."

Looks like a fair set of rules to me, especially the banning only after 90 days if you turn yourself in (unless you get caught).

Personally I only overstayed once for a day due to late booking of my plane ticket, no free seats on the day my visa expired.

Exactly. This guy has intentionally overstayed for 2 years and then expects help from us to relieve the resulting pressure, is hoping to pay a bribe to the judge to save himself a deserved fine and seems to think the Thai govt will arrange a flight for him. I just wonder why he overstayed in the first place.

To the OP.

Just pay the money and get out, I have a 22 month overstay and am finally leaving the Kingdom in the coming days - I have my reasons, none of which are an excuse and I really don't want to go through the vitriol of forum posters who are holier than though.

People fall on bad times, it happens at home or here - I know from experience that this is something I have to do and despite the fact I am leaving my lady of 5 years ( who I am deeply in love with and vice versa ) this is just something that needs to be done. I'm not looking forward to the experience in the airport, but I know I deserve what is coming and if I do get out and back home I will be very grateful as I know I have messed up to a huge extent.

Going to the IDC to save money is crazy, the only reason I am still here is because my lady has been very ill for a long amount of time and I simply wasn't prepared to just leave her, I stayed, payed all the medical fees to get her well again and now she is healthy I have scraped up the money to do the right thing and return home.

Good luck if you go down the IDC route - personally I think its crazy.

I'm always amazed that people have the nerve to overstay. I would be a nervous wreck if I overstayed by an hour! But than again I was brought up to abide the law and not to s#%t in my own nest....

You say that you are heading back home and from your post it seems to suggest that you are thinking that this means the end of your relationship. At the current time there is nothing to stop you from coming back reasonably quickly. I cleared a much longer overstay and flew to KL and returned 4 days later. The only change to that would be to get a visa rather than relying ob visa exempt entry.

Someone replied saying they "were brought up to abide the law" and would never think of overstaying - I'm very happy for you sir that you have never fell on hardship and you're life is all rosy. Hi there everyone, this is how it goes when you are caught for overstaying by an immigration official - I'm speaking from personal experience. Once arrested you will be taken to a local police station and for finger prints and then locked up in a jail cell - basically sleeping on a dirty, cold hard floor. All you will have with you is all the belongings you had on your person or were able to take with you when they arrested you. Then hopefully the next day you'll be hand cuffed and taken to court for your hearing. The judge will fine you for overstaying and depending on whether or not you can pay the fine you will be locked up in prison( NOT IDC). For example I overstayed for 8 months on a touris visa and got fined for 3,000 Baht or 3 months in prison. Then 2 scenarios will follow: either you can't pay the fine and serve your time in prison and then afterwards get relocated to the IDC prison(not a centre) to await your deportation(if you can get the money for your air fare). If not you will be locked up there indefinately. The scond scenario is you pay your fine and skip prison and then go sttraight to IDC prison in BKK. You may also have to wait in a police cell for a few days or weeks before they have transport available to take you to the IDC in BKK - or if you are willing and have money to pay - about 10,000 Baht they will take you to the IDC imediately. It depends off course where you get arrested in which part of the country and how far located you are from BKK.

It is not a great experience to be loked up like this - sleeping on a floor and just having the clothes on your back. You will be sharing the cell with 70-80 other guys - all foreigners also being held for visa/passport issues and even some criminals who commited other crimes awaiting deportation. Some folks in there have been waiting for 15 years or more. I was fortunate to only spend a total of just over half a month in lock up and was able to scrape togther money for the airfaire with the help of some good friends. The food is horrible in there - mainly rice and a watery ix of some vegetable 3 times a day. Once a week or so they bring you sme cookies or somthing sweet that a charity has donated to the IDC for the prisoners in there. It's not very higeinic either - I contracted scabies while I was there, however it only broke out on me after I got back to my home country fortunately. It is a place you want to get out of as quickly as possible, believe me. However I met some interesting people in there and some of them decided to make that place there permanent home as they faced even heavier execution should they return to their home countries. Also many refugees in there too. You'll hear some interesting stories froom the people in there too.

Incorrect information as the rules have changed greatly. Unless you hire a laywer to negociate I think you will be banned for 3 years.
