Resort operators to be hit with civil lawsuits
The Nation

BANGKOK: -- GOVERNMENT officials are preparing to file civil lawsuits seeking compensation from 10 resort operators found guilty of encroaching on or misusing land in Phu Tub Berk, a popular destination in Phetchabun province, the director of the Forest Protection and Fire Control Office said yesterday.

Atthapol Charoenchansa said the Royal Forestry Department (RFD) had also assigned Manop Sai-Unjai, head of the Forest Resource Management Office 4, to ask the provincial public prosecutor to file a request for legal execution to the Lomsak Provincial Court - to make way for the demolition of resorts.

The RFD is gathering information to consider filing civil lawsuits against the 10 resorts to seek additional compensation of about Bt90,000-Bt150,000 per rai, he said.

Chonlatit Surasawadee, chief of the RFD, said officials have been inspecting the resorts since Sunday to confirm the alleged misuse of state land. He said the department had initially concluded that new investors accounted for more than half of the alleged encroachment on forestland at Phu Tub Berk.

As of Monday, the team, led by his deputy Somchai Masathien, reported the arrest of many more land encroachers than the reported figure of 62 cases.

Chonlatit also said the engineering team's inspection of structures at 40 resorts found that many buildings were situated in spots that were at risk from landslides and their structures were not strongly built.

Adirek Wattana-udomchai, an official at Phetchabun Public Works office , confirmed that the structure-checking team at Phu Tub Berk should complete the task on Thursday.

With Phu Tub Berk having been set aside by the authorities for the resettlement of Hmong people, the Department of Social Development and Welfare was surveying the number of Hmong who had original land use rights and built structures there, Puttipat Lertchaowasit, chief of the department, said.

And still no easy-to-do one day GPS survey to put to rest all allegations that Suthep's son and Koh Samui love encroachment.

Interesting.

What's interesting is how everyone else is just glad that someone is doing something against these dirty crooks, but the only thing you care about is someone going after your political enemy.

Old style Pheu-Thai/Red-Shirt right to the core. Reconciliation is impossible because you are full of spite. Did you take your liter of petrol to Bangkok as instructed ready to burn it down ?.

You should have realised by now that none of the top figures on either side are going to get what they deserve.

If K Chonlatit and the engineering team are half correct perhaps an international warning should be sent to all incoming tourists tourists to keep well clear of this place ?

Well, Petchabun is firmly a red stronghold.... Get them all I say. These resorts popping up in national parks is a national disgrace really. It's amazing they just find it so hard to clean them up.

Depends on who you are and the quality of your connections and the depth of your pockets. Its part of the criteria for determination of criminal accountability here.

A survey of the locations of all the homes and second homes of, for example, the thousands of ex- generals/admirals/air marshals/ministers/heads of public companies etc. would demonstrate this point very well.

Encroachment of state land is not criminal?
