BANGKOK: -- The Justice Court yesterday agreed to consider a petition against a former Department of Special Investigation (DSI) chief and three other officials for making false allegations against former prime minister Abhisit Vejjajiva and his then-deputy Suthep Thaugsuban in relation to their role in the deadly 2010 crackdown on red-shirt protesters.

The case had been dropped by other courts, but Abhisit's lawyer Paiboon Pho-noi has sought judges' endorsement in taking the case to the Supreme Court and taken the first step by submitting it for consideration with the Justice Court.

Former DSI chief Tarit Pengdith had accused Abhisit and Suthep of issuing orders with the intention to kill or try to kill people through the crackdown against protesters led by the red-shirt United Front for Democracy against Dictatorship (UDD).

The lawyer said the plaintiffs believed this charge was distorted and that the agency had no authority to pinpoint the wrongdoing. The authority for this lies with the National Anti-Corruption Commission, he said.

Hence the plaintiffs have filed a lawsuit against the former DSI chief and three other concerned officials for making false charges, he added.

Paiboon said the Justice Court accepted the petition after reviewing it. Once the court procedure has been completed, the petition will be forwarded to the Supreme Court either to deliberate on it if it believes the petition has solid ground or drop it.

It is entirely inappropriate for the Justice Court to consider Abhisit’s petition regarding the former prime minister Abhisit Vejjajiva and his then-deputy Suthep Thaugsuban roles in the deadly 2010 crackdown on red-shirt protesters.

NACC is currently conducting an investigation into Abhisit’s and Suthep’s actions as public office holders related to the protest demonstrations. It is, therefore, premature at best and inappropriate at worst for the Court to pursue a parallel review of the same situation. The Court is effectively sabotaging NACC’s investigation:

Thawil Pliensri, who served as director of the National Security Council under Prime Minister Abhisit Vejjajiva, has testified to the NACC that live ammunition was used in the military operation, he insisted that security officers resorted to using firearms only after they were attacked by Redshirt-allied militants on the night of 10 April 2010, and that security officers strictly followed rules of engagement.”

Tarit was following explicit instruction from the paymaster to threaten Abhisit with a murder charge if he didn't go along with the amnesty bill that would pave the way for Takky to come back.

I hope they nail tarit to the wall, he is the epitome of corrupt and deserves to be made an example of.
