Non 'B" Mult. Annual Renewal in Penang - SHOCKED

I have coming to Pennang now for 9 years to renew my Non Imm "B" visa. Never ever had a problem!!!

When I submitted my usual documents the officer was not interested in my documents

as she was with my work permit. When she saw thhat the expiration date was 07 Dec 2015

she told me I could only get a 3 month single entry as the work permit expiration must be

seperated from the visa expiry date by at least 8 months. I showed her my prior 8 years of

one year "B" renewals (even last years). Which Penang issued a one year Non Imm "B" and then I renewed my work permit.

I told her that as per usual when i arrive home on Wed am my accountant lawyer collects my passport

with the new visa and medical check up doc performed last week, they show the new visa in my passport

to the labor dept and return my passport. Usually I get my new stamp in my work permit back in a few days.

She asked if I wanted to get the 3 month visa and that I could come back for the one year once I had renewed

my work permit. Or leave the queue.

I called my lawyer while still at the Thai consulate and they said they would call Labor. I received an email

this afternoon from my lawyer that tried to explain it this way:

After we check with Labor department.

The officer said to extend work permit will refer to company document and company income for consideration.

Not refer to visa anymore.

I am working out of an office in BKK for work in Laos.

I asked if I could after 3 months re-apply for the one year in Laos.

My lawyer stated that Vientiane will NOT renew Non "B" multiple visas.

But she did say that I can get a multipe stamp at the airport for my 3 month visa.

She did say that ohter clients havfe had trouble with renewals in Penang recently.

I still do not understand what happened. Anyone care to explain.

Is it possible to do the following:

>>> get the multiple stamp at the airport before I leave again Wed evening to Laos?

>>> After this 3 month debacle is it possible to renew to a one yr non Imm "B" in Vientiane?

>>> Will I ever be able to get my usual renewal in Penang

>>> Doees Thailand really hate us that much and want us gone?

I live a normal life here with a small business pay my taxes and cause no trouble or harm to anyone.

If your income allows you could extend your stay on a yearly basis at local immigration office and just use a multi re-entry permit for your trips to Laos and not have to worry about going to Penang anymore.

Penang has required 8 months validity remaining on your work permit for a long time now to get a multiple entry non-b visa.

You can get a re-entry permit to keep the 90 day entry from the visa valid. It will expire on the date the 90 day entry expires. A single re-entry permit costs 1000 baht and a multiple 3800 baht.

Vientiane does not do multiple entry non-b visas. Your only choice nearby is Penang.

For the last 12 years i could not get it in Samui.

I had it when we were in Bangkok, never a problem.

Company in business in "The Kingdom" 26 years, have had a work permit 26 years, non B 26 years.

When we moved the company to Samui 14 years ago, I was told by Samui Immigration I would need to add another 1,000,000

in paid up capitol to my company to get a yearly visa?? i have 4X the minimum payed up capitol now in my company.

Books are and have always been correct, taxes, SS, VAT everything.

What are the financial requirements to get a yearly extension of stay.

Now I go on a visa run every 90 days.

That and I am getting to old for that now.

The basic requirements are in clause 2.1 and the annexes of Police Order 327/2557 basis for extension of stay.

​The minimum salary for most western countries is 50k baht. Others are listed in a annex to the police order. For many the problem for getting the extension is the 4 Thai employee requirement.

I am sure Samui immigration will have their own requirements for the supporting documents to get the extension.

A non-b visa is issued based upon business or working.

The non-o is based upon other reasons such as marriage to a Thai, being the parent of a Thai. being 50 or over and etc.

If you are married to a Thai national you could get a 3 month non-o and then extend for 12 months with 400k in the bank - or use your (Thailand taxable) income to prove 40k per month income. You can still hold a work permit either way.

That allows you you to put 400k of your paid up capital to much better use, three months a year.

Alternatively, if over 50 you could consider the retirement visa - which prohibits you from working but you can legally own the company and live here on the proceeds without working.
