Confused about re-newing my 1 year NON-O visa based on marriage

I keep getting told lots of different things regarding my second Non-o visa based on marriage.

I am sure this question has been asked hundreds of times on here but I would just like to get a final answer to my confusion.

I arrived in Thailand April 2015, I have done 2 visa runs and my 3rd at 9 months will be in January 2016.

so when do I need to apply for year 2? my current visa expires April 2016

I believe that once I get the 2nd year in place I no longer need to do visa runs and can sign on instead with proof of address, is this correct?

I have been told that I need 400,000 baht in my Thai account for 3 months before applying therefore if I need to apply in April I will need the money in there at the start of January. I hear of agents that can sort out the whole visa for me in Pattaya including the showing of funds, is this the case and can they be trusted?

Also where and how do I apply ( I live in Pattaya ) if I do it myself ?

sorry for asking so many things in one go, I did tell you that I was confused.saai.gif

I live here with my wife and 2 kids, 1 newborn and would it be devastating to us all if I get this wrong.

You do not have to wait for your visa to expire to apply for an extension of stay based upon marriage. You can do it during the last 30 days of any of the 90 entries you get from the visa.

The 400k baht only has to be in the bank for 2 months.

You would apply for the extension at immigration in Jomtien on soi 5.

To be sure of what you need when you apply for the extension it would be a good idea to go to immigration and get their latest list of requirements.

Did you get married here? If not you would have to register your foreign marriage at an Amphoe.

Visas cannot be obtained or renewed within Thailand.

If you wish to obtain a new multi entry O visa based on marriage then one can be obtained from Savannakhet,Laos.

Alternatively, if you wish to apply for an "extension of stay based on marriage"(it is not a visa) at the Immigration Office then 400,000 Bht in a Thai bank or an income of 40,000 Bht/month certified by your Embassy would be required for the extension.

The money needs to be in the bank for 2 months prior to application.

The immigration office will provide a list of their other requirements.

The process is simple and can be self managed.

Edit: Ah should have Googled first - From Siam Legal's website:

  • The Thai marriage visa holder is entitled permission to stay for a full year in Thailand without the need to exit the country.
  • The visa is renewable every year and the renewal process can be done inside Thailand (requirements for the visa renewal still apply).

So provided I have 400k in the bank I can stay in Thailand indefinitely without border runs.

1. No You make reports of staying longer than 90 days to immigration.

2. You can keep applying for a new extension every year for infinity.

You don't need to use an agent as the application process is simple once you know the requirements. Agents are notoriously unreliable and will do/say anything to ensure they get paid. If you are using an agent because you don't have 400k then rather than conspiring to obtain an extension duplicitously you could get a new multi entry non 'O' visa (5,000 baht) from Savannakhet, Laos without needing to show any money.

If you want to delay getting a new non 'O' visa or applying for an extension of stay you could delay until Sept 2016.

  • Exit/re-enter just before your current visa expires (April) and receive a new 90 day stay.
  • Towards the end of the 90 days (July) you can apply for a 60 day extension of stay to visit your wife for 1,900 baht. (Assuming your marriage is registered in Thailand).
  • Towards the end of that 60 days (Sept) you can apply for a 1 year extension of stay (400k etc.) or go to Savannakhet for a new non 'O' visa (no proof of funds needed).

You will not have to "sign on" at Jomtien every 90 days. You must make your first 90-day report in person. After that, you can submit your reports by mail (or maybe online if that's working for you and your computer browser.) Google "online reports" in the forum.

Just remember that once you get the annual extensions of stay you will no longer have a visa. No problem if you continuously remain in Thailand, but if you want to leave the country and return at any time you will need a re-entry permit.

I keep seeing on here a requirement for Thb 400k, but according to the UK Hull website a nom-immigrant O visa requires proof of Thb 65k per month and there is no mention of a lump sum.

I'm guessing the OP is from Southampton, England based on his username but could be wrong. Am I misunderstanding something or is this now a requirement for a new non-immigrant B and not an extension or renewal? If so, it would seem only monthly income will suffice and not a lump sum.

Have 1year type O multiple entry based on marriage to Thai national. Was issued in Oct this year, phoned the Embassy in London first, no proof of income or funds needed.

The Hull website is wrong. This has been discussed in other topics. Hull apparently only wants to issue tourist visas now.

The OP is already here in the country.

You would need a stack of paperwork from your employer to get a non-b visa. No proof of funds would be needed.

Im pakistani national and im married to thai girl and i got non immigrant type O multiple entry which will expire on april i read a lot of peoples saying about laos savannakhet so i wonder is it possible for me to renew my non immigrant type O multiple entry visa ? Im i but nervous bcz im pakistani and i was thinking savannakhet might only allow to renew for us cizitens or canada etc pls advice

just one other thing,

my visa runs out on 6th of April so I will have the funds in my bank by friday 5th, scraping it I know.

whats the latest I can apply for my 1yr extension ? how long does it take for Jomtien to process?

Is it a put youpaperwork in and hang around until they do it on that day jobby or waiting a few days for it?

i am thinking about applying 5th April as my funds would have been in my bank exactly 2 months or is that too late when my visa runs out the next day. nightmare as i have been waiting for the sale of my house in the UK for longer than I thought. typical!!

Why not just do a border hop and get another one year entry if the 6th of April is the date your visa is expiring. As long as you do an entry on before the enter before date on your visa you will get another one year entry. Then you would need a re-entry permit to keep that last entry valid if you want to travel.

What you would be extending is your permit to stay not your visa. The admitted until date on your last entry stamp is what you will be extending.

Sorry got post mixed up about what visa you have. If it is your visa that is expiring you could do another border hop for a new 90 day entry.

What is your current permit to stay date on your last entry stamp. If you don't want to do the border hop that would be the date you must do the extension by not the date your visa expires.

I have no idea if reentry permits are available at the Friendship bridge.

If you are crossing at the bridge in Nong Khai you could apply for the re-entry permit there. It is one of the few border crossing that has a re-entry permit desk. If not you would have to apply at your local immigration office for it.

A single re-entry permit costs 1000 baht.

Visas are never extended.

If you wish to apply for an "extension of stay" most people would prefer not to apply at the last moment.

If think you mean the 2 or 3rd of February You could apply on the 4th of April. Normally you should be able to get the application accepted on the same day you apply as long as you have all the required documents. You will get a under consideration stamp that will have a report back date 30 days from when your application is accepted. You will get your extension stamp on that date if the approval is completed.

If you could not apply on or before the 6th you could apply for a 60 day extension to get more time to do the one year extension application,.

Yes i meant February. My funds have been in my account since the 1st therefore I plan to go to my bank in the morning on the 1st of April to get a letter confirming that I have had them in there for 2 months and then head over to Jomtien Immigration with my docs and apply on that day.

The miserable bloke at Immigration told me i should apply no later than a week before my non-o runs out for my 1yr extension, I have been worried but if what you say is correct then 5 days should be fine ( I hope)

The criteria states "that applicant and his spouse must contact the office in person to give statements"

I assume that they just mean that we must apply in person and that nobody can do so on our behalf.
